RESOLUTION 88-4 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAI, USE PERMIT TO <br />RICHARD AND EILEEN BERGMANN, COUNTRY SUN FARM FOR <br />GREENHOUSE AND SALES LOT IN THE AGRICULTURAL ZONING DISTRICT <br />WHEREAS, Richard and Eileen Bergmann have applied for a <br />Conditional Use Permit for a Greenhouse and Sales Lot on the South <br />534.9 feet of the North 925.9 feet of the West 1/2 of the Northwest <br />1./4 of Section 1,T29, R21W; and the North 300 feet feet of the <br />Easterly 640 feet of the East 1/2 of the Northwest 1/4 of the <br />Northwest 1/4 of Section 1 T29N, Range 21W, at 5833 Lake Elmo Avenue <br />North in the City of Lake Elmo from; and has submitted all required <br />information and fees for the application for such permit; and, <br />WHEREAS, Section 301.070 D. l.b. (1) and (5) of the <br />Municipal Code of Lake Elmo requires a Conditional Use Permit to <br />operate a Greenhouse and Sales Lot in the City of Lake Elmo; and, <br />WHEREAS, Sections 301.130 C.,D.,E., and G of the Municipal <br />Code of Lake Elmo sets forth the conditions under which said permit <br />may be granted and such use permitted; and, <br />WHEREAS, the applicants meet or exceed all the conditions <br />set forth above. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo, <br />THAT, the Conditional Use Permit for a Greenhouse and Sales <br />Lot at 5833 Lake Elmo Avenue North is hereby granted to Richard and <br />Eileen Bergmann. <br />This Conditional Use Permit will be reviewed on an annual basis, and <br />may be rescinded, after a 2 week notice and a public hearing, if. the <br />City Council finds that the public health, safety, or welfare is <br />jeopardized. <br />ADOPTED, this 5t.h day of January, 1988, by the City Council <br />of the City of Lake Elmo, Washington County, Minnesota. <br />J) <br />Signed <br />Arlyn Christ <br />Attest: <br />
