RESOLUTION 88-6 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO <br />HELEN MILLER FISHER FOR A PRIVATE DOG KENNEL <br />(MEADOW MILL KENNEL) IN THE R-1 ZONING DISTRICT <br />WHEREAS, Helen Miller Fisher has applied for a Conditional <br />Use Permit for a private dog kennel on Lots 23-23 of Bordner -Garner <br />Gla' Farmettes at 8139 38th Street North in the City of Lake Elmo; and has <br />0 submitted all required information and fees for the application for <br />such permit; and, <br />WHEREAS, Section 301.050E of the Municipal Code of Lake Elmo <br />requires a Conditional Use Permit to operate a private dog kennel in <br />the City of Lake Elmo; and, <br />WHEREAS, Sections 1402 of the Municipal Code of Lake Elmo <br />sets forth the conditions under which said permit may be granted and <br />such use permitted; and, <br />WHEREAS, the applicant meets or exceeds all the conditions <br />set forth above. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo, <br />THAT, The Conditional Use Permit for a private dog kennel at <br />8139 38th Street North is hereby granted to Helen Miller Fisher, <br />(MEADOW MILL KENNEL) subject to the following conditions: <br />1. No dogs may be boarded. <br />2. This use is not transferable <br />3. No open burning is allowed on this <br />property per State Statute. <br />This Conditional Use Permit will be reviewed on an annual basis, and <br />may be rescinded, after a 2 week notice and a public hearing, if the <br />City Council finds that the public health, safety, or welfare is <br />jeopardized. <br />ADOPTED, this 5th day of January, 1988, by the City Council <br />of the City of Lake Elmo, Washington Co __y, Minnesot ti�Q <br />Signed: <br />Arlyr.
