RESOLUTION 88-12 <br />_ CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO <br />R.J. O'NEIL FOR VALI-HI DRIVE IN THEATRE IN THE <br />GENERAL BUSINESS ZONING DISTRICT <br />WHEREAS, R.J. O'Neil has applied for a Conditional Use <br />Permit for a drive-in theatre on the SW1/4, SW1/4 of Section 36, T29, <br />R21, except the S 219.5 feet of the E. 847.7 feet thereo£,(for which a <br />site layout is on file with the City Clerk) at 11260 Hudson Boulevard <br />in the City of Lake Elmo; and has submitted all required information <br />and fees for the application for such permit; and <br />WHEREAS, Section 301.070 D.7.a. (9) of the Municipal Code of <br />Lake Elmo requires a Conditional Use Permit to operate a drive-in <br />theatre in the City of Lake Elmo; and, <br />WHEREAS, Sections 301.130 L of the Municipal Code of Lake <br />Elmo sets forth the conditions under which said permit may granted <br />and such use permitted; and <br />WHEREAS, the applicant meets or exceeds all the conditions <br />set forth above. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo, <br />THAT, the Conditional Use Permit for Vali-Hi Drive -In at <br />11260 Hudson Boulevard is hereby granted to R.J. O'Neil, subject to <br />the following conditions: <br />1. There shall be licensed deputies on duty Fridays, Saturdays <br />and holidays when more than 50 cars are anticipated. <br />2. The owner shall prevent litter from this use to scatter <br />to adjoining property. <br />3. The parking area and drives shall be treated to control <br />dust. <br />This Conditional Use Permit will be reviewed on an annual basis, and <br />may be rescinded, after a 2 week notice and a public hearing, if the <br />City Council finds that the public health, safety, or welfare is <br />jeopardized. <br />ADOPTED, this 5th day of January 1988, by the City Council <br />of the City of Lake Elmo, Washington Counjy,innesota,'; <br />( Signed �� <br />` Arlyn=Christ, Mayor <br />Attest: �:tng <br />�,��Mary Kuef ner, ACity Administrator <br />
