RESOLUTION 88-14 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO <br />HOWARD GELB AND TRANS -•CITY INVESTMENTS TO ALLOW THE <br />ALTERNATIVE AGRICULTURAL USE OF AN EXISTING COMMERCIAL STYLE <br />BUILDING AND ADJACENT PARKING AREA <br />WHEREAS, Howard Gelb has applied for a Conditional Use Permit <br />under Section 301.070 D.1.b.6 of the Municipal Code of Lake Elmo <br />to allow the operation of various agricultural -related and <br />non-agricultural related commercial businesses in an existing <br />62,000 square foot building in a 5-acre area designated as "Parcel <br />B" in the site plan submitted to the City; and <br />WHEREAS, the purpose of this Conditional Use Permit shall be <br />to allow the landowner to obtain a reasonable return from the <br />agricultural land and still maintain the open spaces and <br />preservation of agricultural use; and <br />WHEREAS, the Conditional Use Permit applies to the entire <br />40-acre land parcel described as follows: the Northeast Quarter <br />of the Southwest Quarter of Section Thirty -Six (36); T29N, R21W; <br />and also All that part of the Northwest Quarter of the Southeast <br />Quarter of Section Thirty --six (36), T29N, R21N described as <br />follows, to wit: Commencing at the Southwest corner of the <br />Northwest Quarter to the Southeast Quarter; thence North along the <br />West line a distance of 152 feet to a point; thence Southeasterly <br />in a straight line to a point on the South line of said Northwest <br />Quarter of the Southeast Quarter to a point; said point being <br />located 33 feet East of the point of beginning; thence West 33 <br />feet to the point of beginning; and the West two (2) rods of the <br />South Half of the Southeast Quarter of Section 36, T29N, R21N, <br />Washington County; commonly known as 11490 Hudson Boulevard; and <br />WHEREAS, the alternative agricultural uses are to be allowed <br />on a five (5) acre parcel "B" described in the survey of March 23, <br />1987 as follows: The South 450.00 feet of the North 695.00 feet <br />of the West. 484.00 feet of the Northeast Quarter of the Southwest <br />Quarter of Section 36, T29N, R21N; and <br />WHEREAS, the following six (6) businesses are allowed to <br />lease space and operate in the existing building as alternative <br />agricultural uses: Tortilla Factory,, Product: Vending Systems, <br />Huang Trading Import Company, Diversified Bank Installations, <br />Nordic Concepts, and Rygmyr Foods; and <br />WHEREAS, Howard Gelb will notify the City if and when <br />existing alternative agricultural uses move out of the building <br />and are proposed to be replaced by other alternative agricultural <br />uses, subject to the potential impact of such new businesses on <br />the operation of the septic systems potential need for additional <br />parking spaces on the five (5) acre site and other applicable code <br />requirements. <br />
