LAKE ELMO CITY COUNCIL MINUTES JUNE 6, 1989 PAGE 3 B. PUBLIC HEARING: (1) Variance--Sideyard Setback (2) Variance--Drainfield Setback (3) Variance --Driveway Setback R. Scott & Heidi Nietzel, 3291 Lampert Mayor Dunn opened up the public hearing at 7:30 p.m. in the City Council chambers. Notice of the public hearing was duly published and sent. There was no one to speak for or against the application. R. Scott & Heidi Nietzel, 3291 Lampert, have applied for three variances to the side yard setback, setback from drainfield, setback from driveway. If these variances are granted, the applicant proposes to construct a 30' x 24' accessory structure. City Engineer Larry Bohrer presented his review, dated June 5, 1989. Bohrer had reviewed the perc tests and are similar in both the front and backyard. Therefore, a combination of the yard behind the garage and expanding to the north, but still keep the setback from the north property line, could be an alternate drainfield site. Scott and Heidi Nietzel stated their hardship was they owned two cars and needed a two car garage and this was the only spot on the property you could build a garage. The existinggaragewouldbe left, but they have future plans to make the old garage into living space. The Nietzel's stated they do plan on removing the old driveway and move it over so the driveway goes along the side of the house. Sharon and Len Johnson, 3271 Lampert Avenue N., submitted a statement in which they were in favor of the proposed improvement and encourages completion. Mayor Dunn closed the public hearing at /7/:/.3"V.IW./ 7:34 n.m. (Amended 7/18) MIS/ Graves/Moe - to grant the following (3) variances based on the hardship being this is the only site available on the property and on the letter of approval by Len and Sharon Johnson M/S/P Hunt/Williams - to add to the motion the recommendations from the City Engineer as Conclusions. (Motion carried 5-0). M/S/P Graves/Moe - to grant the following (3) variances to Scott and Heidi Nietzel, 3291 Lampert Avenue N., in order for them to build a 30' x 24' garage based on the hardship this is the only site available on the property, the old driveway will be removed and the new driveway will be straight to the new garage, on the letter of approval by Len and Sharon Johnson; with City Engineer's recommendations stated in his Review letter dated June 5, 1989 be used as conclusions. (Bohrer strongly recommended the existing septic system be marked out in the yard so that no construction traffic drives over it.) (1) A driveway setback from the side lot line of 0.5 feet where 5 feet is required. (2) A structure setback from the side lot line of 8 feet where 10 feet is required.
