LAKE ELMO CITY COUNCIL MINUTES JUNE 6, 1989 PAGE 3 <br />B. PUBLIC HEARING: (1) Variance--Sideyard Setback <br />(2) Variance--Drainfield Setback <br />(3) Variance --Driveway Setback <br />R. Scott & Heidi Nietzel, 3291 Lampert <br />Mayor Dunn opened up the public hearing at 7:30 p.m. in the City Council <br />chambers. Notice of the public hearing was duly published and sent. <br />There was no one to speak for or against the application. <br />R. Scott & Heidi Nietzel, 3291 Lampert, have applied for three variances <br />to the side yard setback, setback from drainfield, setback from driveway. <br />If these variances are granted, the applicant proposes to construct a 30' <br />x 24' accessory structure. <br />City Engineer Larry Bohrer presented his review, dated June 5, 1989. <br />Bohrer had reviewed the perc tests and are similar in both the front and <br />backyard. Therefore, a combination of the yard behind the garage and <br />expanding to the north, but still keep the setback from the north property <br />line, could be an alternate drainfield site. <br />Scott and Heidi Nietzel stated their hardship was they owned two cars and <br />needed a two car garage and this was the only spot on the property you <br />could build a garage. The existinggaragewouldbe left, but they have <br />future plans to make the old garage into living space. The Nietzel's <br />stated they do plan on removing the old driveway and move it over so the <br />driveway goes along the side of the house. <br />Sharon and Len Johnson, 3271 Lampert Avenue N., submitted a statement in <br />which they were in favor of the proposed improvement and encourages <br />completion. <br />Mayor Dunn closed the public hearing at /7/:/.3"V.IW./ 7:34 n.m. (Amended 7/18) <br />MIS/ Graves/Moe - to grant the following (3) variances based on the <br />hardship being this is the only site available on the property and on the <br />letter of approval by Len and Sharon Johnson <br />M/S/P Hunt/Williams - to add to the motion the recommendations from the <br />City Engineer as Conclusions. (Motion carried 5-0). <br />M/S/P Graves/Moe - to grant the following (3) variances to Scott and Heidi <br />Nietzel, 3291 Lampert Avenue N., in order for them to build a 30' x 24' <br />garage based on the hardship this is the only site available on the <br />property, the old driveway will be removed and the new driveway will be <br />straight to the new garage, on the letter of approval by Len and Sharon <br />Johnson; with City Engineer's recommendations stated in his Review letter <br />dated June 5, 1989 be used as conclusions. (Bohrer strongly recommended <br />the existing septic system be marked out in the yard so that no <br />construction traffic drives over it.) <br />(1) A driveway setback from the side lot line of 0.5 feet where <br />5 feet is required. <br />(2) A structure setback from the side lot line of 8 feet where <br />10 feet is required. <br />
