RESOLUTION 89-40 CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION GRANTING A LARGE LOT SUBDIVISION TO STEVEN J. DAHLY WHEREAS, Steven J. Dahly has made application to the City of Lake Elmo for a Large Lot Subdivision of the property descirbed as follows: The East 1/4 of the Northeast 1/4 of the Southeast 1/4 of Section 28, Township 29 North, Range 21 West, Washington County, Minnesota, containing 20 acres, more or less, into two tracts legally described as follows, to wit: PARCEL "A" .The West 1/2 of the East 1/2 of the Northeast 1/4 of the Southeast 1/4 of Section 28, Township 29 North, Range 21 West, Washington County, Minnesota subject to an easement over the North 33 feet thereof for 15th Street North and also subject to an AMOCO pipeline easement per Document No. 558286. PARCEL "B" The East 1/2 of the East 1/2 of the Northeast 1/4 of the Southeast 1/4 of Section 28, Township 29 North, Range 21 Weest, Washington County, Minnesota, subject to an easement over the North 33 feet thereof for 15th Street North and also subject to an AMOCO pipeline easement per Document No. 558286. WHEREAS, the Lake Elmo Planning Commission considered this application at a public hearing on March 27, 1989 and recommended the approval thereof; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo as follows, to wit: The application of Steven J. Dahly for a Large Lot Subdivision for the real estate described above, be and the same hereby_is granted, based on the following conditions: 1. The applicant provides a survey showing the dimensions of the pipeline easement. 2. The applicant dedicate a 33 foot right-of-way street and utility easement to the City of Lake Elmo. 3. The applicant pays a park dedication fee of $450 for the newly created lot. 4. That all principal structures be set back a minimum of 100 feet from the pipeline.
