MINUTES APPROVED: December 5, 1989 <br />MINUTES ISSUED: December 15, 1989 <br />LAKE ELMO CITY COUNCIL MINUTES <br />NOVEMBER 21, 1989 <br />Mayor Dunn called the City Council meeting to order at <br />City Council chambers. Present: Dunn, Hunt, Williams, <br />7:08 p.m.), City Engineer Bohrer and City Administrator <br />Councilman Moe. <br />1. AGENDA <br />7:02 p.m. in the <br />Graves (arrived <br />Morrison. Absent: <br />Add: 11D. Tri-Lakes Assoc Request for waiver of fee permit for signs, 12. <br />OTHER: Update on Groundwater Contamination, Request on Fill Ordinance. <br />M/S/P Williams/Hunt - to approve the November 21, 1.989 City Council agenda <br />as amended. (Motion carried, 3-0). <br />2. MINUTES: November 7, 1989 <br />M/S/P Williams/Hunt - to approve the November 7, 1989 City Council minutes <br />as amended. (Motion carried 3-0). <br />3. CLAIMS: <br />M/S/P Graves/Hunt - to approve the November 21., 1989 Claims #92530 thru <br />#92601 as presented. (Motion carried 4-0). <br />POINT OF ORDER: <br />Mayor Dunn reported something had been called to her attention that she <br />wanted to bring to the Council's attention. Dunn referred to State Statute <br />#351.02 Vacancies: Every office shall become vacant on the happening of <br />either of the following events before the expiration of the term of such <br />office: <br />(1) the death of an incumbent; <br />(2) the incumbent's resignation; <br />(3) the incumbent's removal; <br />(4) the incumbent's ceasing to be an inhabitant of the state, or, if the <br />office is local, of the district, county, or city for which the incumbent <br />was elected or appointed, or within which the duties of the office are <br />required to be discharged. <br />Dunn explained for the last several weeks, she had heard discussion <br />privately here on her side and phone conversations that there might be a <br />concern about residency of Don Moe. She personally stopped down at his <br />home at 61 Cimarron, no one was there, the place was entirely different. <br />She stopped at City Hall several times and asked if there was anything new <br />that she should know about. Once again, nothing was related to her. On <br />November 2nd she phoned 436-6083 which is Don's number and the number had <br />been changed. <br />Dunn made an inquiry to the Washington County Assessor's office because <br />she had head rumors that he had moved to Oakdale. Don attended the Lake <br />Elmo City Council meeting on November 2nd, but he made no comment about <br />
