ORDINANCE NO, 8027 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />AN ORDINANCE AMENDING SECTION 803 OF THE 1979 <br />MUNICIPAL CODE OF LAKE ELMO, RELATIVE TO <br />ISSUANCE OF BURNING PERMITS <br />The City Council of the City of Lake Elmo ordains: <br />Section 1. Amendment, Section 803 of the 1979 Municipal <br />Code of Lake Elmo, is hereby amended to read as follows: <br />803. OPEN BURNING (OF REFUSE) PROHIBITED <br />803.010. Adoption by .Reference: (The Ambient Air Quality <br />standards, Air Pollution Control: regulations of the Minnesota <br />Pollution Control Agency) Minnesota Rules, parts 70'05.0700 to <br />7005.0820, Open Burnie Re str ctabns and Permitting Regulations, <br />are ereb'y ado pt° ' 'y 'ref'erenc'e,` and have :the same force andffect <br />803.020. Official Copy: One copy of Minnesota Rules, parts <br />7005.077 to 7005.0820 (the standards and regulations) sha be <br />m-a iced as an of icia copy and filed for use and examination by <br />the public in the office of the City Administrator. <br />803.030 Recreational Fire: Recreational fires are defined <br />in the (standards) rules as being fares which do not exceed four <br />(4) feet in diameter, and three (3) feet in height. Recreational <br />fires which exceed this size must have a permit. <br />803,040, Permits: Open burning shall be prohibited in the <br />City without Permit approval from the Fire Chief, or his designee. <br />Burning permits may be issued, by the Fire Chief or his designee <br />for: <br />...disposition of diseased trees; <br />...first time clearing of property for construction purposes; <br />...when it is deemed safe by the Lake Elmo Fire Chief and is <br />in compliance with MPCA rules and standards. <br />803.050. Violation: Any <br />provisions of (the Ambient Air <br />Control Regulations) these ru <br />and subject to a fine of ''$= <br />person violating <br />Quality Standards <br />es shall be guilt <br />T'for each violat <br />any of the <br />and Air Pollution <br />y of a misdemeanor, <br />Section 2.
