RESOLUTION NO. R— 89-16 <br />A RESOLUTION FOR THE CITY OF LAKE ELMO <br />OF COMPLETE SUPPORT FOR LEGISLATION <br />REPEALING THE AUTHORITY OF THE MINNESOTA MUNICIPAL BOARD <br />TO DETACH FROM A MUNICIPALITY ANY LAND BASED UPON A PETITION OF <br />AFFECTED LANDOWNERS <br />WHEREAS, the City of Lake Elmo is located in Washington County, <br />Minnesota; and <br />WHEREAS, the City of Lake Elmo is bordered oa two sides by heavily used <br />metropolitan freeways; and <br />WHEREAS, the City of Lake Elmo has developed over the course of many <br />years a carefully considered Comprehensive Plan and Zoning Code for the purpose <br />of preserving'the predominantly rural character of the City of Lake Elmo while <br />permitting steady and controlled commercial growth 'along freeway corridors, as <br />well as within the other.commercial areas of the City; and <br />WHEREAS, the City of Lake Elmo has not been as enthusiastic a promoter <br />of taxpayer's subsidies for development as has its neighboring "m"u'tticipalities; <br />and <br />WHEREAS, as a result of this more conservative approach and concern for <br />the integrity of its Comprehensive Plan, developers and landowners adjacent to <br />neighboring cities have, in an effort to seek those public subsidies and avoid <br />the provisions of Lake Elmo's zoning regulations, petitioned or threatened to <br />petition the Municipal Board of Minnesota in an effort to detach themselves from <br />the City of Lake Elmo; and <br />WHEREAS, it is the belief of the City Council and citizens of Lake Elmo <br />that this effort goes well beyond the originally intended purpose of Chapter <br />414, which grants authority to the Minnesota Municipal Board; and <br />WHEREAS, if all pending and threatened detachments by landowners were <br />to occur, the City of Lake Elmo could, within a year, lose up to 14% of its <br />current land area; and <br />WHEREAS, the City of Lake Elmo believes that this authority on the part <br />of the Municipal Board to accept petitions from landowners is now being seized <br />upon by developers as an effort to disrupt the very integrity of municipalities <br />and their authority to enact reasonable zoning regulations and comprehensive <br />plans; and <br />
