RESOLUTION 89-39 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A SIMPLE LOT <br />SUBDIVISION TO JAMES AND VIVIAN PALECEK <br />WHEREAS, James and Vivian Palecek have made application to the <br />City of Lake Elmo for a Simple Lot Subdivision of the property <br />described as follows: <br />That part of the Northwest Quarter of the <br />Northwest Quarter of Section 22, Township 29 <br />North, Range 21 West, City of Lake Elmo, <br />Washington County, Minnesota, described as <br />follows: <br />The West 240 feet of the Northwest Quarter of the <br />Northwest Quarter of Section 22, Township 29 <br />North, Range 21 West, Washington County, <br />Minnesota, EXCEPT the North 475 feet thereof. <br />Subject to a 16.5 foot road easement along the <br />East side of this description, and subject to a 16 <br />foot easement along the South side of this <br />description to Northern States Power Company. <br />This parcel contains 4.65 acres, more or less. <br />WHEREAS, the Lake Elmo Planning Commission considered this <br />application at a regularly scheduled meeting on August 28, 1989 and <br />recommended the approval of the above described parcel into two <br />parcels described as follows: <br />Parcel 1 <br />The South 315.00 feet of the North 790.0 feet of the West <br />240.00 feet of the Northwest Quarter of the Northwest <br />Quarter of Section 22, Township 29 North, Range 21 West, <br />Washington County, Minnesota. <br />Subject to the right-of-way of Jamley Avenue North over, <br />under and across the East 30.00 feet thereof. <br />Subject.to an Easement for storm water drainage purposes <br />only, over and across all that part of the Northwest Quarter <br />of the Northwest Quarter of Section 22, Township 29 North, <br />Range 21 West, Washington County, Minnesota, being a strip <br />of land 15.00 feet in width and 7.50 feet on either side of <br />the following described centerline: Commencing at the <br />northwest corner of said Northwest Quarter of the Northwest <br />Quarter, thence southerly along the westerly line therof <br />475.00 feet; thence easterly parallel with the northerly <br />line of said Northwest Quarter of the Northwest Quarter <br />210.00 feet; thence southerly parallel with said westerly <br />line 215.00 feet to the point of beginning of the centerline <br />description of the 15.00 wide storm water drainage easement; <br />thence westerly parallel with said northerly line and along <br />
