RESOLUTION NO. 90-41 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION IN OPPOSITION TO THE CITY OF OAKDALE'S <br />REQUEST THAT THE MINNESOTA MUNICIPAL BOARD INITIATE A <br />PROCEEDING TO CONSIDER THE CONCURRENT DETACHMENT AND <br />ANNEXATION OF CERTAIN PROPERTY LOCATED WITHIN <br />THE CITY OF LAKE ELMO <br />WHEREAS, the City of Lake Elmo has opposed the concurrent <br />detachment and annexation of certain property within its corporate <br />boundaries as identified in Minnesota Municipal Board File No. <br />D-239/A-4453 (herein the "Brockman Annexation"); and <br />WHEREAS, the Minnesota Court of Appeals is scheduled to review <br />the Brockman Annexation on January 30, 1991; and <br />WHEREAS, the City of Lake Elmo has opposed the concurrent <br />detachment and annexation of certain property within its corporate <br />boundaries as identified in Minnesota Municipal Board File No. <br />D-248/A-4573 (herein the "Enright Annexation"); and <br />WHEREAS, the action of the Minnesota Municipal Board in the <br />Enright Annexation has been appealed to the Washington County <br />District Court; and <br />WHEREAS, throughout the proceedings involving the Brockman and <br />Enright Annexations, it has been and continues to be the position <br />of the City of Lake Elmo that it has the statutory right to control <br />the development of property within its corporate boundaries and <br />that in furtherance of such right it has systematically adopted and <br />revised Comprehensive Plans and Official Controls; and <br />WHEREAS, the City's prior Comprehensive Plans have been <br />reviewed and approved by the Metropolitan Council and the City's <br />current Comprehensive Plan has been submitted for review and <br />approval to the Metropolitan Council; and <br />WHEREAS, the City of Lake Elmo is capable of and willing to <br />provide government services to all property within its corporate <br />boundaries; and <br />WHEREAS, the Minnesota Municipal Board's decisions in the <br />Brockman and Enright Annexations have seriously undermined the tax <br />base of the City of Lake Elmo and have adversely impacted the <br />implementation of the City's Comprehensive Plan. <br />1 <br />
