RESOLUTION 90- 0 0 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AMENDING RESOLUTION 88-14 <br />TO INCLUDE OUTSIDE STORAGE AS PART OF <br />AN ALTERNATE AGRICULTURAL CONDITIONAL USE PERMIT <br />TO HOWARD GELB AND TRANS -CITY INVESTMENTS <br />WHEREAS, Howard Gelb has applied for, and was granted a <br />Conditional Use Permit under Section 301.070 D.1.b.6 of the Municipal <br />Code of Lake Elmo to allow the operation of various <br />agricultural -related and non-agricultural related commercial <br />businesses in an existing 62,000 square foot building in a 5-acre area <br />designated as "Parcel B" in the site plan submitted to the City; and <br />WHEREAS, the purpose of this Conditional Use Permit shall be to <br />allow the landowner to obtain a reasonable return from the <br />agricultural land and still maintain the open spaces and preservation <br />of agricultural use; and <br />WHEREAS, the applicant has requested an amendment to the existing <br />Conditional Use Permit which will allow outside storage within the <br />confines of an existing fenced -in area on the north side of the <br />building which is approximately 29,000 square feet in size; and <br />WHEREAS, the Lake Elmo Planning Commission held a public hearing <br />on this request on March 26, 1990 and recommended, unanimously, that <br />the amendment be granted with the following conditions: <br />1. The area of storage not exceed 29,000 square feet <br />currently existiing within a fenced area. <br />2.. The height of storage within the fenced area <br />not exceed a height of 7 feet. <br />3. Items be stored in an orderly, neat manner so as <br />to insure the safety of workers in the area. <br />4. No hazardous chemicals, including, but not limited <br />to organic solvents, acids and alkali material be <br />permitted within the outside storage area. <br />5. No Perishable goods be stored in this area. <br />6. No additional exterior lighting will be provided. <br />NOW, THEREFORE, BE IT RESOLVED, that an amendment to the existing <br />Conditional Use Permit for an alternative agricultural use as allowed <br />by Section 301.070 D.1.b.(6) is hereby granted to allow for outside <br />storage is hereby granted to Howard Gelb and Trans -City Investments. <br />This Conditional Use Permit will be reviewed on an annual basis, and <br />may be rescinded, after a 2 week notice and a public hearing, if the <br />City Council finds that the public health, safety, or welfare is <br />jeopardized. <br />
