Member Uj ) ia,m5 <br />moved its adoption: <br />RESOLUTION 90-1 <br />introduced the following resolution and <br />CITY OF LAKE ELMO <br />RESOLUTION REVOKING SUSPENSION OF BUILDING PERMIT #89-254 <br />WHEREAS, on July 29, 1989, Stephen D. and Elizabeth M. Johnson <br />executed a Purchase Agreement for the purchase of 2945 Lake Elmo <br />Avenue North in the City of Lake Elmo, contingent upon the sale of <br />the Johnson's existing home at 5931 Hytrail Avenue North, Lake <br />Elmo, MN, and other matters, (see Purchase Agreement attached as <br />Exhibit 1); and <br />WHEREAS, on September 21, 1989, Mr. and Mrs. Johnson executed <br />an application for a mortgage loan on 2945 Lake Elmo Avenue North <br />(see Mortgage Application attached as Exhibit 2); and <br />WHEREAS, on the 28th day of September, 1989, Mr. and Mrs. <br />Johnson made application for a variance on the property located at <br />2945 Lake Elmo Avenue North to permit the construction of a 2,000 <br />square foot storage building and a public hearing pursuant thereto <br />was scheduled on October 17, 1989, at 7:30 p.m. (see Notice of <br />Public Hearing attached as Exhibit 3); and <br />WHEREAS, the legal description of 2945 Lake Elmo Avenue North <br />is as set forth in the title opinion of H. Gordon Taylor, (see <br />Certificate of Title Opinion attached as Exhibit 4); and <br />WHEREAS, on October 17, 1989, the City Council of the City of <br />Lake Elmo denied the request of Mr. and Mrs. Johnson for a variance <br />to construct a 2,000 square foot storage building (see Variance <br />Application attached as Exhibit 5); and <br />WHEREAS, at the City Council meeting of October 17, 1989, Mr. <br />Johnson requested information from the City Council about the <br />possibility of erecting a 1,000 square foot accessory building with <br />a 1,000 square foot canopy to keep snow off of his motor home and <br />the City Council directed Mr. Johnson to contact the Building <br />Official with his request because they looked at the request as a <br />building code question (see Lake Elmo City Council Minutes attached <br />as Exhibit 6); and <br />WHEREAS, Mr. Johnson made several inquiries of Jim McNamara, <br />the Building Official of the City of Lake Elmo and on October 29, <br />1989, Mr. Johnson received confirmation by telephone from Mr. <br />McNamara that the construction of a 1,000 square foot storage <br />building with a 1,000 square foot canopy would be permitted; and <br />WHEREAS, on October 30, 1989, Stephen Johnson received <br />building permit #89-254 authorizing the construction of a 1,000 <br />square foot storage building and a 1,000 square foot canopy area <br />(see Building Permit attached as Exhibit 7); and <br />
