Member Uj ) ia,m5 moved its adoption: RESOLUTION 90-1 introduced the following resolution and CITY OF LAKE ELMO RESOLUTION REVOKING SUSPENSION OF BUILDING PERMIT #89-254 WHEREAS, on July 29, 1989, Stephen D. and Elizabeth M. Johnson executed a Purchase Agreement for the purchase of 2945 Lake Elmo Avenue North in the City of Lake Elmo, contingent upon the sale of the Johnson's existing home at 5931 Hytrail Avenue North, Lake Elmo, MN, and other matters, (see Purchase Agreement attached as Exhibit 1); and WHEREAS, on September 21, 1989, Mr. and Mrs. Johnson executed an application for a mortgage loan on 2945 Lake Elmo Avenue North (see Mortgage Application attached as Exhibit 2); and WHEREAS, on the 28th day of September, 1989, Mr. and Mrs. Johnson made application for a variance on the property located at 2945 Lake Elmo Avenue North to permit the construction of a 2,000 square foot storage building and a public hearing pursuant thereto was scheduled on October 17, 1989, at 7:30 p.m. (see Notice of Public Hearing attached as Exhibit 3); and WHEREAS, the legal description of 2945 Lake Elmo Avenue North is as set forth in the title opinion of H. Gordon Taylor, (see Certificate of Title Opinion attached as Exhibit 4); and WHEREAS, on October 17, 1989, the City Council of the City of Lake Elmo denied the request of Mr. and Mrs. Johnson for a variance to construct a 2,000 square foot storage building (see Variance Application attached as Exhibit 5); and WHEREAS, at the City Council meeting of October 17, 1989, Mr. Johnson requested information from the City Council about the possibility of erecting a 1,000 square foot accessory building with a 1,000 square foot canopy to keep snow off of his motor home and the City Council directed Mr. Johnson to contact the Building Official with his request because they looked at the request as a building code question (see Lake Elmo City Council Minutes attached as Exhibit 6); and WHEREAS, Mr. Johnson made several inquiries of Jim McNamara, the Building Official of the City of Lake Elmo and on October 29, 1989, Mr. Johnson received confirmation by telephone from Mr. McNamara that the construction of a 1,000 square foot storage building with a 1,000 square foot canopy would be permitted; and WHEREAS, on October 30, 1989, Stephen Johnson received building permit #89-254 authorizing the construction of a 1,000 square foot storage building and a 1,000 square foot canopy area (see Building Permit attached as Exhibit 7); and
