WHEREAS, the City Council, on September 5, 1989 granted preliminary approval for the <br />subdivision of Packard Park Third Addition, on the condition that the Developers enter into this <br />agreement to provide for the installation of streets, utilities, landscaping and other improvements <br />hereafter described in the terms and conditions hereafter set forth; and <br />WHEREAS, the Developers hereby warrant and represent to the City as inducement to the City's <br />entering into this Agreement that Developer's interest in the land area of the Development is fee <br />owner; and <br />WHEREAS, the Developers agree to provide permanent drainage and ponding easements. <br />NOW, THEREFORE, and in consideration of the premises and of the mutual promises and <br />conditions hereinafter contained, it is hereby agreed as follows: <br />IMPROVEMENTS <br />In accordance with the policies and ordinances of the City, the following described <br />improvements shall be constructed and installed on the terns and conditions hereinafter <br />contained: <br />A. Street grading, gravel base, bituminous surfacing, bituminous curb, construction of <br />berms and boulevards, and turf restoration including seeding and mulching <br />(hereinafter called "Street Improvements); <br />B. Drainage facilities, including all necessary storn sewers, catch basins, ponds, inlets <br />and other appurtenances as well as seeding and mulching (hereinafter called <br />"Storm Sewer Improvements"); <br />C. Standard street name signs at all newly opened intersections, "No Parking" signs, <br />and such other traffic control signs within the subdivision determined to be <br />necessary by the City Engineer (hereinafter called "Traffic Signing <br />Improvements"); <br />D. Underground gas, electric and telephone service to be arranged by the Developers <br />with the utility companies involved (hereinafter called "Utility Improvements"); <br />C <br />
