CONTRACT FOR CITY PROSECUTION SERVICES <br />1.1 Carl A. Blondin, Attorney at Law, Minnesota Attorney <br />License 157661, with offices at 7475 15th Street north, Suite <br />204, Oakdale, Minnesota 55128 agrees to provide his services as <br />City Prosecutor to the City of Lake Elmo for the calendar year <br />1990 for the fee of $900.00 per month ($10,800 for the entire <br />year). <br />2.1 Prosecution services shall include all District Court <br />appearances for all City Ordinance violations, and all petty <br />misdemeanors, misdemeanors and gross misdemeanor violations of <br />Minnesota Statutes, except for those matters that Minnesota <br />Statutes state must be prosecuted by the County Attorney or the <br />Attorney General. <br />2.2 Prosecution services shall also include representing the <br />City in any habeas corpus actions in United States District Court <br />for the District of Minnesota brought by a person convicted of an <br />offense described in paragraph 2.1 of this contract and <br />prosecuted by the Lake Elmo City prosecutor. <br />3.1 Prosecution services shall not include appeals to the <br />Minnesota Court of Appeals, the Supreme Court of Minnesota, or <br />the United States Supreme Court. <br />3.2 Carl A. Blondin shall not initiate an appeal on behalf of <br />the City of Lake Elmo without prior approval of the City Council, <br />or if the City Council sets up a procedure for the appeal of <br />criminal and petty misdemeanor decisions without prior approval <br />of the City Council, he shall not perfect an appeal without first <br />strictly complying with the City's procedures. <br />3.3 Carl A. Blondin shall immediately notify the City <br />Administrator and the City Council of any appeals brought by a <br />defendant in any matter he is obligated to prosecute under this <br />contract. <br />3.4 Prosecution services shall not include the costs <br />associated with an appeal such as service of notices and motions, <br />printing and other incidental costs. <br />3.5 The Lake Elmo City Council is free to hire Carl A. <br />Blondin or any other attorney it so chooses to represent the City <br />of Lake Elmo in any appeal of an Ordinance violation or other <br />matter prosecuted by the Lake Elmo City prosecutor. <br />
