The specific action the Grantee wants the Agency to take The Agency will respond within 45 days with a decision or a request for further information. -,. 1. if it a request for further information, the Agency will indicate a. The type of decision; b. The basis for the decision, i including, iF applicable (1) Federal Law; (2) Title 40 EPA Regulations; r (3) EPA Policy; and/or f (4) EPA guidance. C. If the dispute is an issue of State Iaw,'State'lioIicy or ` State guidance, the Grantee mill be notified that the issue is not appealable under the Federal Construction Grants Program disputes procedure and the Agency will make the decision based on the State Construction Grants Program Disputes Procedure. d. The grantee's right to request review by the next entity. Where the decision is by the Director, Division of Water quality, Lhe grantee will be notified of its right to request Region review: under 40 CFR 35.3030 and that such a request must: (1) Be filed by registered mail, return receipt requested, addressed to the Regional Disputes Decision Official, Attention: Chief, Municipal Facilities Branch, U.S. Environmental . Protection Agency, 230 South Dearborn Street, Chicago, Illinois 60604; (2) Include a statement of the amount in dispute; (3) Include a description of the issues i Jived; (4) Include a concise statement of the objections to the State decision; (5) include a copy of all written State decisions and communications and all grantee communications and documents applicable to the dispute; and (6) Be received by the Region within 30 days of the date of the State decision.
