The specific action the Grantee wants the Agency to take <br />The <br />Agency will respond within 45 days with a decision or a request <br />for <br />further information. -,. <br />1. <br />if it a request for further information, the Agency will indicate <br />a. What specific 'Information is being requesLed; <br />b. Why it is being requested; and <br />C. That the grantee has 45 days to respond or the Agency's <br />previous decision becomes the State's final decision. <br />2. <br />if it is a decisi'gnLhe.Agency will indicate via certified mail, <br />return <br />receipL requested <br />a. The type of decision; <br />b. The basis for the decision, i including, iF applicable <br />(1) Federal Law; <br />(2) Title 40 EPA Regulations; <br />r <br />(3) EPA Policy; and/or <br />f <br />(4) EPA guidance. <br />C. If the dispute is an issue of State Iaw,'State'lioIicy or <br />` <br />State guidance, the Grantee mill be notified that the issue is <br />not appealable under the Federal Construction Grants Program <br />disputes procedure and the Agency will make the decision based on <br />the State Construction Grants Program Disputes Procedure. <br />d. The grantee's right to request review by the next entity. <br />Where the decision is by the Director, Division of Water quality, <br />Lhe grantee will be notified of its right to request Region review: <br />under 40 CFR 35.3030 and that such a request must: <br />(1) Be filed by registered mail, return receipt requested, <br />addressed to the Regional Disputes Decision Official, Attention: <br />Chief, Municipal Facilities Branch, U.S. Environmental . <br />Protection Agency, 230 South Dearborn Street, Chicago, <br />Illinois 60604; <br />(2) Include a statement of the amount in dispute; <br />(3) Include a description of the issues i Jived; <br />(4) Include a concise statement of the objections to the <br />State decision; <br />(5) include a copy of all written State decisions and <br />communications and all grantee communications and documents <br />applicable to the dispute; and <br />(6) Be received by the Region within 30 days of the date of <br />the State decision. <br />
