REQUEST FOR COUNCIL -ACTION <br />Meeting Date May 21, 1991 <br />kCzcN DA SECTION PLANNING/LAND USE & ZONING <br />ORIGINATING- <br />DE?ARTMENT. <br />BY: <br />I TEM : PUBLIC HEARING: Vacation of Walkway Easement to I APPROVED FOR <br />DeMontreville Park AGENDA BY: <br />This is a public hearing to consider a <br />for the vacation of a walkway easement <br />DeMontreville Highlands 4th Addition. <br />explaining why the request has been made, <br />from the Park Commission where this item <br />on a 7 to 2 vote not to vacate the city <br />A copy of the -petition, letter <br />vicinity map, and the minutes <br />was discussed and recommended <br />access to DeMontreville Park. <br />petition submitted to the City <br />between Lots 13 and 14, Block 3, <br />It appears to me that the City acquired the park in 1976, some thru <br />purchase and some thru park dedication for the.DeMontreville Park <br />Subdivision. Then it appears,that the City acquired .the walkways. <br />I have tried to piece together the series of events that lead up to <br />where we now are. <br />In 1976, the City purchased or as dedicated what amounts to approx. <br />31.6 acres (21.3 and 8.3) for park land. <br />In early 1980, a walkway easement was dedicated to the City for access <br />to the park thru Lot 14, At that time, it apparently was planned to <br />have the "active park" located on the 21.3 acre parcels. <br />Sometime after that, (1980-81?) the City developed a Master Park -Plan, <br />done by David A. Kuscht Associates with a Lawcon Grant. That plan <br />shows the active park to be on the 8.3 parcel and the 21.3 acres to <br />be more of a passive nature walkway/cross country skiing park. <br />The Master Plan also shows two entrances to the trails, neither of them <br />thru the walkway easement on Lot 14. No improvements have been made <br />to the 21.3 parcel and there is a play area, and a ballfield, etc., <br />on the 8.3 parcel. <br />What the City Council must determine when vacating an easement is that <br />it serves no public purpose. With the development of the Master Plan, <br />I can think of no benefit to the public to keep an access in such <br />close proximity to what is shown on the Plan. <br />Assuming the Council will concur with this finding, the following motion <br />is offered for your consideration: <br />Motion: , Second , to adopt <br />Resolution - vacating the easement 6escribed in said resolution, <br />based on the finding that this easement serves no public purpose and <br />that ingress and egress to DeMontreville Park is provided to the park <br />for the general public in two different locations, one being tithin <br />750 feet of easement being vacated. <br />
