MEMO <br />TO: CITY COUNCIL <br />FROM: CITY ATTORNEY <br />DATE: March 15, 1976 <br />SUBJECT: Demontreville Highlands Plat/Demontreville Park <br />As you will recall, on January 20, 1976, the Council approved the <br />rezoning of certain lands named, owned by Allied Properties, Inc., and gave <br />concept approval a proposed plat presented by Mr. Roger Derrick, as agent. <br />The concept approval of the plat was subject to a number of conditions. <br />One of those conditions was that the developer and the City reach an agreement <br />on the acquisition of land for "Demontreville Park" within the budget previously <br />established by the City - namely, $60,000.00. <br />On January 31, 1976, a meeting was held between Mr. Derrick and Mr. <br />Gottsacker representing the developer,and the City Attorney, the City Planner, <br />and Park Chairman representing the City, for the purpose of outlining the <br />details of a proposed agreement on that park acquisition which could be submitted <br />to the City Council for its approval <br />At that meeting those prasent agreed to submit to the City Council the <br />following proposal: <br />1. That the developer would sell the City 15 acres and dedicate to the <br />City as part of its plat an additional 8.3 acres so as to establish a <br />Park of 23.3 acres in size. <br />2. In addition to the Park land to be dedicated in this plat, the <br />developer would dedicate the following easements to the City as part <br />of the plat: <br />(a) An easement for access to Lake Demontreville. This <br />easement would terminate at such time as the DNR purchases <br />the fish hatchery and provides public access to the lake. <br />This easement would be for boat launching, etc. and would <br />include about 100 feet of lakeshore. <br />(b) A drainage easement to Lake Demontreville. This easement <br />could be over the same area as the access easement described <br />in (a). <br />(c) The "historic road" located by the Park Committee would <br />be included as part of the plat. <br />3. The City would pay the developer $56,250.00 (some funds had <br />already been spent for the survey by the City) for the above sale and dedication <br />
