5-/ Z • 9z.-. <br />CITY OF LAKE ELMO <br />ORDINANCE NO. <br />AN ORDINANCE ADDING CHAPTER 750 rO THE LAKE ELMO <br />MUNICIPAL CODE RELATING TO THE CREATION OF A <br />SURFACE WATER MANAGEMENT UTILITY <br />The City Council ordains as an addition to the Municipal Code: <br />Chapter 750 is hereby added to read as follows to the Municipal Code of the <br />City of Lake Elmo: <br />750. SURFACE WATER MANAGEMENT UTILITY <br />750.010 General Operation <br />The Municipal surface water system shall be operated as a public utility <br />(hereinafter called the surface water management utility), pursuant to <br />Minnesota Statutes Section 444.075, from which revenues will be derived <br />subject to the provisions of this Chapter and Minnesota Statutes. <br />750.020 Definitions <br />A. Utility Equation <br />The utility equation is defined as the amount of runoff volume, in <br />inches, for a particular land use, assuming a 2" rainfall and Soil <br />Conservation Service (SCS) "Type B" soil conditions. <br />B. Surface Water Management Fee <br />The surface water management fee is defined as the yearly charge <br />developed for each parcel of land. <br />C. Yearly Surface Water Management Revenue <br />The yearly surface water management revenue is the estimated <br />yearly expenditures for planning and inventories, capital expenditures, <br />personnel and equipment and operation of the surface water utility, in <br />accordance with established City policy. The surface water <br />management revenue and resulting surface water management fees <br />shall be reviewed yearly by the City Council <br />-1- <br />
