LAKE ELMO CITY COUNCIL MINUTES MAY 5, 1992 7 <br />M/S/P Williams/Mottaz - to adopt Ordinance No. 8064 adopting <br />Section 303 Floodplain Management of the Lake Elmo Municipal <br />code as amended at the 5-5-92 Council meeting and repealing <br />Section 304. (Motion carried 5-0). <br />M/S/P Hunt/Dick Johnson - to approve the publication of a <br />Summary of Ordinance 8064 relating to Flood Plain Management <br />within the City. (Motion carried 5-0). <br />E. CITY PARK PLAN <br />City Planner, Mike Black, provided a final draft of the Park <br />Plan that was prepared by the Parks Commission with the <br />assistance of our planner. <br />The Council reviewed the plan and indicated, in general, the <br />plan was good and agreed to the proposed changes suggested <br />by Councilman Williams. There was discussion on the need or <br />desire to see if all trails could or should be connected and <br />asked for a definition of the different trails as mentioned <br />on Page 8 of the plan. Also, Councilman Mottaz questioned <br />if there is a need for the number of proposed "neighborhood <br />parks" based on the large lots that we require in new <br />developments. <br />Mrs. Terry Boczek suggested the Council wait for the <br />recommendation from the committee who will be reviewing the <br />proposed trailway. Mrs. Boczek voiced her concern that the <br />plan, if approved as it relates to the trailway system on <br />DeMontreville, that at some point in time a trail system <br />would be put in without regard to the terrain and/or <br />wetlands. <br />Mike Black will have a revised copy of the City Park Plan <br />for the next Council meeting. <br />F. Proposed Amendment to Lake Elmo Code relating <br />to the number of votes required to amend or <br />approve a Conditional Use Permit <br />At their April 27, 1992 meeting, the Planning Commission <br />held a public hearing to consider amending the code to <br />require a 4/5ths vote to approve a new or amended <br />Conditional Use Permit. The PZ recommended the Council not <br />approve this proposed amendment. <br />Mayor Johnson explained he saw zoning as the act of allowing <br />uses of land to affect the welfare of the residents of the <br />city and Conditional Use Permits do precisely the same <br />thing. Our city code allows CUP's in any zoning district. <br />These uses do not, cannot, or simply will not, meet the <br />stringent requirements of the zoning district. <br />
