LAKE ELMO CITY COUNCIL MINUTES JANUARY 5, 1993 7 <br />M/S/P Mottaz/Conlin - to direct the staff to write a letter <br />! to the Bergmann's instructing them to provide an updated <br />site plan to the Building Inspector before the January 19th <br />council meeting. (Motion carried 5-0). <br />Hammes Minina CUP: <br />Jim McNamara reported that Hammes Mining has been crushing <br />concrete and aggregate and selling materials near County <br />Road 10 that may or may not have been processed on their <br />property. At this time there isn't a glass recycling <br />operation on the site or any land reclamation being done. <br />None of these conditions are in the CUP. Jim has been <br />working with the Hammes family on specific amendments to the <br />CUP. <br />When the Hammeses come in to explain what their intended use <br />is of their site, the Council will determine if this use <br />fits the definition of mining and whether they are in <br />compliance with their CUP. If the use doesn't fall under the <br />mining definition, the Council would have to determine if it <br />is an activity that they would allow in the Ag Zone. <br />Consequently, the regulations would have to be amended <br />accordingly and the PZ would be directed to have a hearing <br />to consider an amendment to the text of the code. <br />MIS/ Mottaz/Johnston - to direct the staff to write a letter <br />to Hammes Mining instructing them to submit their intended <br />use of their property to the Code Enforcement Officer within <br />30 days. <br />M/S/P Johnston/Johnson - to amend the motion to include the <br />staff indicate the letter that presently it is the city's <br />view Hammes Mining is not in compliance with their CUP and <br />to point out those aspects which are not in compliance. <br />(Motion carried 5-0). <br />M/S/P Mottaz/Johnston - to direct the staff to write a <br />letter to Hammes Mining instructing them to submit their <br />intended use of their property to the Code Enforcement <br />officer within 30 days and also indicate that presently it <br />is the city's view Hammes Mining is not in compliance with <br />their CUP and point out those aspects which are not in <br />compliance. (Motion carried 5-0). <br />The Council accepted the review of the Building Inspector on <br />the Conditional Use Permits. The Hammes Cleanup will be <br />discussed at the January 19th meeting. <br />
