surrounding the temporary turnaround to at least as good of a <br />condition as existed prior to the construction of the temporary <br />turnaround. The temporary turnaround shall be paved with blacktop <br />according to Lake Elmo City Standards. Said construction shall be <br />completed in such a fashion that the Plaintiffs are not denied <br />access to their lot. <br />9. That after City Council approval of the minor <br />subdivision, the parties mutually agree to jointly petition the <br />Lake Elmo City Council to vacate the remainder of the Isle Avenue <br />North right-of-way between the temporary turnaround located on <br />Springborn's Acres 2nd Addition and Jane Road North. <br />10. That in the event the Lake Elmo City Council vacates <br />the Isle Avenue North right-of-way as described above, and in the <br />event said vacation results in the Plaintiffs losing the use of <br />said right-of-way (as they currently possess) for ingress and <br />egress .to and from their property, then and in that event, <br />Plaintiffs are granted a 30 foot wide easement for purposes of <br />ingress and egress to and from their property, over and across the <br />southern 2.16 acre (more or less) lot. Said easement shall exist <br />over the western -most 30 feet of said southern lot. <br />11. That in the event the Lake Elmo City Council does <br />not approve the minor subdivision, according to the terms specified <br />herein, then both parties shall jointly petition the Lake Elmo City <br />Council for improvement of Isle Avenue North from Springborn's <br />Acres 2nd Addition to Jane Road North. Said Petition shall request <br />a 22 foot wide public road to be blacktopped and constructed <br />5 <br />
