LAKE ELMO CITY COUNCIL MINUTES <br />OCTOBER 26, 1993 <br />Mayor John called the council meeting to order at 7:08 p.m. in the city council chamber. <br />PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer Bohrer and <br />Administrator Kueffner. <br />1. AGENDA <br />M/S/C Conlin/Johnson - to approve the October 26, 1993 City Council agenda as <br />presented. (Motion carried 5-0). <br />1993 MSA IMPROVEMENTS: <br />Mayor John opened up the Public Hearing at 7:10 p.m. in the council chambers. The <br />public hearing notice to pass upon the proposed assessment for the 1993 MSA <br />Improvements, Reconstruction of Jamaca Avenue between TH5 and Lake Jane Trail <br />and Lake Jane Trail between Jamaca Avenue and Jane Road was published in the <br />October 12, 1993 Stillwater Gazette and the Stillwater Gazette Extra on October 13, <br />1993 and all affected property owners were notified. <br />Larry Bohrer reported the total amount to be assessed is $48,950 which is only about 5 <br />1/2% of what the total project actually costs. The remainder is made up of Municipal <br />State Aid Funds. It is proposed to assess each buildable lot abutting these streets <br />$1,100/1-ot. For the purpose of assessment, a lot is defined as the maximum number of <br />lots which a parcel could be divided into under present zoning. <br />No. of Units: 44 1/2 Total Assessment: $1,100/Unit <br />Mayor John closed the public hearing at 7:15 p.m. <br />Jim Jungmann, 9404 Lake Jane Trail, asked the following questions: When and who is <br />going to take care of the damage done to his property? The brick columns on the west <br />end of his driveway have been tilted because of excavation and the elevation of his <br />driveway needs to be taken care of. He was asked if they could move the power pole <br />back into his property 4'. If he allows this, how are the trimming of his trees going to be <br />handled? <br />Bohrer explained in order to qualify for state aid funds we have to construct the road in <br />accordance to state standards. One of the standards is safety if a car should leave the <br />road. There should not be any fixed objects within 32' of the center line of the road. <br />Bohrer will inquire from NSP if alley arms could be used and will have a NSP <br />representative in charge of tree trimming look at the trees to see if they can be <br />trimmed uniformly. Bohrer will set up a meeting with Mr. Jungmann in order to review <br />these concerns. <br />
