LAKE ELMO CITY COUNCIL MINUTES APRIL 19, 1994 6 <br />Mayor John closed the public hearing at 10:15 p.m. <br />Jim McNamara, Building Official, provided a copy of the building permit issued to <br />John Nicholson, 8975 15th St. N., for a house and detached garage. Inspections <br />were made on the house and garage. No inspections were called, nor made, for <br />the second accessory building. <br />M/S/C Mottaz/John - to deny the after -the -fact variance for'setback of accessory <br />building requested by John Nicholson/Patricia Ganly, 8975 15th St. N., based on <br />the recommendations of the city planner in memo dated April 18, 1994. (Motion <br />carried 5-0.) <br />M/S/C Mottaz/Johnson - to instruct John Nicholson, 8975 15th St. N., to <br />discontinue housing animals in the accessory building, or bring the building into <br />compliance with the city code within 90 days. (Motion carried 5-0.) <br />B. Request form DNR to Lower Land Elevation at DeMontreville Park <br />M/S/C Johnson/Johnston - to allow the DNR to lower land elevation between <br />Pond B & Pond C, as shown on map dated 9-3-93, approx. one foot to allow the <br />water to flow into DeMontreville Park wetland; contingent upon the control <br />structure on the outlet of Capaul's Pond be closed when the DeMontreville <br />wetland reaches 950 in elevation and authorize the city engineer to work with <br />Mike Bouthilet. (Motion carried 5-0). <br />7. CITY ENGINEER'S REPORT: <br />A. 1993 MSA UPDATE <br />Larry Bohrer provided an update on the 1993 MSA Project in his letter to the <br />Council dated April 14, 1994. <br />M/S/C John/Mottaz - to acknowledge the individual requests received by April <br />22, 1994 with whatever trees remain should be used up. (Motion carried 5-0). <br />8. CITY ATTORNEY'S REPORT: <br />9. CITY COUNCIL REPORTS: <br />Mayor John submitted a memo dated April 18,1994 on the discussion of the <br />Joint Powers Agreement with Oakdale. <br />M/S/C Mottaz/Conlin - to hold a special council meeting to talk about strategies <br />for Section 32/33 on Wednesday, April 27, 7 p.m. at city hall. (Motion carried 5- <br />0). <br />
