Finnerty, Executive Director <br />Subject: Proposed Settlement Agreement Between the Commission and Meredith <br />Cable Regarding Rate Regulation <br />The Commission will find enclosed with this agenda item a copy of a draft <br />proposal for a Renewal Option and Regulatory Stipulation Agreement between the <br />Ramsey/Washington Cable Commission and Meredith Cable. The proposed <br />agreement relates to the Commission's rate regulation process which began in <br />September 1993, and culminated in its Resolution 5-12-94 regarding the regulation of <br />rates charged for basic cable service and related equipment which was adopted in <br />May of 1994, as well as a current review by the Commission of Meredith Cable's <br />revised rates as specified in its filing of FCC Form 1200. <br />In particular, the purpose of the agreement is to resolve the dispute between <br />the Commission and Meredith Cable regarding the treatment of certain PEG costs <br />with respect to basic cable rates. <br />The proposed points of such resolution are as follows: <br />1. Meredith would comply with the Commission's rate refund order as <br />specified in the Commissions Resolution 5-12-94. This would mean that <br />Meredith would make a refund to subscribers of over $500,000, complying <br />with the Commission's refund order. <br />2. Meredith would agree to continue providing operational funding for PEG <br />access related functions, at the option of the Commission or the member <br />cities and townships of the Commission, in a renewal or extension of the <br />cable television franchise. <br />3. Going forward, the Commission would authorize the cable company to treat <br />certain of its PEG -related costs "externally," thus allowing the company to <br />recover tho costs wlthin its basic cable service rate. <br />4. Meredith would implement a universal PEG tier of service plan which would <br />allow nonsubscribers to receive local cable access channels, including <br />government, public, and educational access, free of charge to the individual <br />universal PEG service subscriber. At the same time, the Commission would <br />authorize a necessary channel realignment to implement a'universal PEG <br />service. <br />
