Why Repeal Alternative Ag?
1. Because the ordinance did not define
permitted "Non traditional agricultural uses
and non agricultural uses", nor associated
architectural standards.
2. Because the CUP "stayed with the land", and
would be difficult to rescind once awarded.
3. Because only two instances of Alt. Ag. have
occurred in the City over the eight years it has
been in existence, even though it was intended
to provide the farmer/land owner a reasonable
return on the property.
4. Because the Alternate Use should be viewed in
the wider context as to whether the City would
permit any such activity within the City
boundaries, and in particular in an
Agricultural area.
5. Because every forty acre agricultural parcel
within Lake Elmo could potentially host a 1.5
acre non agricultural use.
6. Because as a City wide Ordinance, it could be
viewed as spot zoning.
