LAKE ELMO CITY COUNCIL MEETING SEPTEMBER 19, 1995 <br />H. Local Government Official's Regional Forum <br />M/S/P Hunt/Conlin - td direct the staff to publish the required notice in the City's legal newspaper relating <br />Council's attendance, at the Local Government Officials' Regional Forum schedule for Thursday, October <br />5, 1996 at the White Bear City Hall. (Motion passed 5-0). <br />6. OLD BUSINESS: <br />A. ASSESSMENT policy (Discussed under City Engineer's Report) <br />7. PLANNING. LAND USE & ZONING: <br />A. Case No. SUB/95-22 "Beaut Crest" amended Final Plat <br />Planner Terwedo reported at the September 5, 1995 Council meeting, a modification to the Beaut Crest <br />final plat was presented. This modification reflected the north cul-de-sac on the plat terminating <br />approximately 200 ft. east of the west property line. The change had not been reviewed by the City <br />engineer prior to the meeting and not presented to the Planning Commission. Since the Council meeting, <br />the City engineer has discussed his concerns with the developer and the developer has agreed to move <br />the cul-de-sac back to the western edge of the property. This plan reflects the plat approved by the <br />Planning Commission and approved by the City Council at preliminary plat approval. <br />M/S/P Conlin/Johnston - to approve the Final Plat for Beaut Crest Estates, as presented, dated August <br />28, 1995, as recommended by the Planning Commission. (Motion passed 5-0). <br />B. Case No. SUB/95-26 Preliminary Plat (12-lot subdivision formerly Fox Fire Manor) <br />Applicant: Ken Gervais, Image Development <br />The public hearing for the preliminary plat for a major subdivision of a 40 acre parcel of property into 12- <br />single family lots was held by the Planning Commission on August 14, 1995. The proposal was approved <br />by the Commission on August 28, 1995. This plat, presently named Fox Fire Manor, is the same <br />subdivision which received Final Plat approval by the City on June 21, 1991. Due to certain <br />circumstances, the Final Plat was never filed with Washington County and the extensions granted by the <br />City expired on August 1, 1993. The property went through foreclosure in 1994. <br />Planner Terwedo reported the preliminary plat, as presented, has not been modified to reflect the <br />comments made by the City Engineer in his letter dated August 10,1995. Specifically, the street section <br />needs to be modified to reflect a 28 ft. width instead of a 24 ft. width. The Planning Commission <br />requested a 60 ft. easement between lot 3 and 5 which would terminate at the north property line of lot 4. <br />The easement would identify a future road extension to the south. Larry Bohrer stated that access to this <br />property would be difficult due to the steep grades and wetlands. The landscape plan will have to be <br />modified to reflect our existing standards. <br />Variance Request: <br />At the July 12, 1995 Planning Commission meeting, questions were raised regarding lot 4, bik 2, the 8 <br />acre parcel. Due to the configuration of the parcel, ft is a flag lot which is not allowed by Section <br />301.070.13 of the Lake Elmo Municipal Code. The past approved plat also did not show a cul-de-sac. It <br />was removed during the course of the review process due to the fact that this would never be a through - <br />street because of the topography and wetland issues. There was also adequate access to this <br />subdivision from 55th Street from Rolling Hills and Arabian Hills. The Planning Commission <br />recommended the Council grant a variance to frontage on a public street for flag lot (Lot 4, Block 2) <br />Planner Terwedo recommended the variance be granted to allow this flag lot for the following reasons: <br />1. The granting of this variance would not be detrimental to the public welfare. <br />2. There are special circumstances due to the topography and wetland which would not allow the road to <br />extend. <br />
