LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 5, 1995 <br />Larry Bohrer has discussed with Randy Peterson, the concern on when laying the pipe along Lake Jane <br />Trail there is a single T-watermain where 81 homes in the affected landfill area, are relying on this main <br />for water and cannot be taken out of service. <br />M/S/P Hunt/Conlin - to direct the City to send a letter to VBWD voicing its opinion that this project bid be <br />let this Fall, and the project should start in the Spring with reason being the risk of closing down Lake <br />Jane Trail, which is a main thorough fare, is too high should there be an early melt and the road becomes <br />non -passable. (Motion passed 5-0). <br />Gordon Moosbrugger, VBWD Board Manager, stated the pond level has subsided and the plug does not <br />need to be pulled yet, but during the spring thaw it might be necessary to pull the plug. The VBWD <br />adopted a motion to direct Zetterberg to negotiate an extension of an easement across Mr. Winkel's <br />property back into the lake until January 31,1996 or construction, whichever is first. At a public meeting <br />on July 31, President Zetterberg said that allowing the pond to permanently flow into Olson Lake was not <br />an option since the DNR probably would not grant a long-term permit. Council member Johnston stated <br />her disappointment with the Board of Managers, as a whole, in the granting of the permit extension when <br />it was said at the hearing that no such extension would be requested or granted. <br />C. St. Croix Valley Youth Bureau - Request for Funding <br />M/S/P John/DeLapp - to postpone discussion until Mr. Weiler, St. Croix Valley Youth Bureau can attend <br />meeting. (Motion passed 5-0). <br />6. PLANNING/LAND USE & ZONING: <br />A. Case #SUB/95-19 Torre Pines Final Plat <br />Preliminary Plat approval for the subdivision of a 78.43 acre parcel of property into 24 single family lots, <br />Torre Pines, was approved by the City Council on July 18, 1995 and a list of conditions were included. <br />The Planning Commission approved the final plat at their meeting on August 28, 1995. <br />Planner Terwedo reported the Final Plat, as presented, reflects the preliminary plat for Torre Pines which <br />the city approved. As discussed in the staff report for the final plat presented to the PZ at their meeting <br />of August 28th, the site was Inspected for oak wilt. No signs of the disease were found. <br />The Council received a letter from Larry Bohrer, dated September 1,1996 stating he has reviewed the <br />final plat of Torre Pines as prepared by Midwest Land Surveyors and Civil Engineers, Inc. and the plat is <br />in accordance with the approved preliminary plat. <br />M/S/P DeLapp/Hunt - to adopt Resolution No. 95-44 approving the Final Plat for Torre Pines as amended <br />and entering into a developers agreement conditioned on the following: <br />1. The applicant meets the conditions set forth by the Valley Branch Watershed District in its letter dated <br />June 12, 1995. <br />2. The applicant meets the conditions as set forth by the City Engineer in his letter dated June 12, 1995 <br />3. The access permit from Washington County shall be submitted to the City. <br />4. A detailed analysis of the trees one each site shall be submitted to the City Planner in order to <br />determine if additional landscaping will be required. Responsibility to comply with the ordinance rests <br />with the developer, <br />5. A detailed plan for the entrance island and boulevard landscaping for the development shall be <br />reviewed and approved by the City Planner. <br />
