LAKE ELMO CITY COUNCIL MEETING FEBRUARY 20, 1996 4 <br />D. Berschen Properly Rezoning: Request for EAW <br />The City received a petition under the rules of the Environmental Quality Board to require an <br />Environmental Assessment Worksheet (EAW). The purpose of an EAW is to identify the potential <br />environmental impacts of a particular project to aid in the determination whether further environmental <br />review is necessary in the form of an Environmental Impact Statement (EIS). <br />Larry Bohrer reported in his letter, dated February 16, 1996, that a review of the mandatory categories for <br />project of this type clearly reveals this project is not in the mandatory category. A review of the exempt <br />categories indicates this project may be exempt. It is Larry Bohrer's recommendation that the evidence <br />presented in the petition or known to the City does not demonstrate that this project has the potential for <br />significant environmental effect and the petition for an EAW should be dismissed. Bohrer provided a <br />timetable for the maintenance building to be finished by November 1, 1996. <br />The Council discussed if a comprehensive plan amendment would be required before it can rezone the <br />property to Public Facility designation, and this will be investigated by the City Attorney and staff. <br />M/S/P HunUDeLapp - to postpone consideration of an EAW until the March 4, 1996 council meeting so <br />residents can present further information for a request to perform an EAW. (Motion passed 5-0). <br />M/S/P HunUDeLapp - to postpone consideration of rezoning the Berschen property until the March 4, <br />1996 meeting with the request that the staff prepare answers for the council on a couple of the points <br />raised concerning the amendment to the comprehensive plan and whether or not that would be required <br />in advance of the rezoning and any other relevant points raised that the staff should be concerned with <br />for the rezoning. (Motion passed 4-1:Conlin:I'm not against postponing, but I will not be here for the <br />March 4th council meeting.) <br />M/S/P HunUDeLapp - to reconsider the motion for postponing consideration of an EAW. (Motion passed <br />5-0). <br />M/S/P Hunt/Johnston - to amend the motion to postpone consideration of an EAW until the March 4th <br />council meeting to allow public comment and evidence to the City be submitted by 4:30 p.m., February <br />27, 1996. (Motion passed 5-0). <br />Counctlmember Hunt suggested setting a workshop at the maintenance facility for residents to see how <br />well the maintenance dept. runs the shop with the hope that this visit would reduce neighborhood <br />concerns about the imapct of the shop on nearby residences. <br />M/S/P Hunt/Conlin - that the staff be directed to set up a workshop for Saturday, March 2nd, 9-10:30 a.m <br />at the current maintenance facility to review the operation of the facility with any interested residents and <br />that the staff have someone from the maintenance dept. available to answer questions and explain <br />functions and direct the staff, at their discretion, notify all the affected residents of the Berschen property. <br />(Motion passed 5-0). <br />M/S/P Hunt/Johnston - that the staff be given permission to begin work on building plans and <br />specifications (type of construction, materials) for the new maintenance facility that when they feel it is <br />appropriate and direct the staff if they do decide to go ahead to appoint three to five residents from the <br />area be involved in the site and building design along with one Council member, City Planner, City <br />Engineer, and member of the MAC. (Motion passed 5-0). <br />Names of people interested in serving on the site and building design committee were submitted to the <br />City Administrator. <br />
