The Council directed the <br />Engineer to investigate the situation. <br />Background <br />In 1984, the City awarded a construction contract to Forest Lake Contracting for the <br />reconstruction of 45th Street. Julep Avenue, and 47th Street from Jane Road to Keats Avenue. <br />The contract called for a certain amount of fill soil to be furnished by the contractor. The <br />contractor negotiated with John Berschens to obtain this soil from the powertine easement which <br />was owned by Berschens but wasn't being tilled. This area is west of the Friend and Petrellis <br />property and at a higher elevation. It is my recollection that no property east of the powerline <br />was disturbed. <br />Analysis <br />Since we could not determine where the drainage breaks were by eye, we took some elevation <br />shots on the Berschens property. The attached diagram shows that about 3 acres of Berachens <br />property drains west while the remainder drains east, It is also interesting that the west edge of <br />the powerline easement is about 10, - 15' lower than the east edge of the powerline easement, <br />The land slopes gradually to the south burmore steeply to the west. <br />Friend owns Lot 1 and the south 1/2 of Lot 2. Petrellis owns Lot 3 and the north 1/2 of Lot 2, <br />The drainage runs west toward Lake Jane on the common line between these two properties. The <br />property owners are concerned about erosion and that the drainage may affect a septic system, <br />Solution <br />Since the land gradually slopes to the south, a berm could be constructed on the west line of the <br />powerline easement to direct the runoff to the 45th Street road ditch. The water would then run <br />along the south line of Friend's lot to Jane Road. I believe a berm was constructed by Forest <br />Lake Contracting in 1984 but may have since been overtopped and eroded through. I will be <br />meeting with the property owners Monday afternoon so I will have a report at the Council <br />meeting.
