LAKE ELMO CITY COUNCIL MINUTES JULY 2, 1996 <br />Mayor John called the council meeting to order at 7:00 p.m. in the Council chambers. PRESENT: John, <br />Johnston, Del-app, City Engineer Tom Prew, City Attorney Filla, City Planner Terwedo and Administrator <br />Kueffner. ABSENT: Hunt, Conlin <br />1. AGENDA <br />ADD: 7B. Parks Dept. recommendation on mower, 8D. Set up workshop on TIF, 8E. Letter from Met. Co. <br />regarding comprehensive plan amendment for Open Space Development <br />M/S/P Johnston/DeLapp - to approve the July 2, 1996 City Council agenda as amended. (Motion passed <br />3-0). <br />2. MINUTES: <br />M/S/P Del-app/Johnston - to approve the June 18, 1996 City Council Minutes as amended. (Motion <br />passed 3-0). <br />3. CLAIMS <br />M/S/P Johnston/DeLapp - to approve the July 2, 1996 claims #4869 through #4912, as presented <br />(Motion passed 3-0). <br />4. PUBLIC INFORMATIONAL <br />A. Public Inquiries <br />Sue Dunn, 11018 Upper 33rd St., stated she has been following events that have been happening in the <br />City the last six months and has concerns about the future of the City with regard to financial <br />responsibility to the taxpayers. The City is out of touch with the residents. We are becoming more and <br />more like Woodbury and Oakdale... increase debt load, taxes, bureaucratic control, decrease quality of <br />life. <br />Ann Bucheck, 2301 Legion Avenue N., asked where do we stand on sewer along 1-94. Will there be an <br />oversize improvement. If United Properties doesn't build on this property, what happens to our taxes, <br />who will pay? If they don't build will the City change their standards for development or stay with the <br />same standards we have. If so, will there be a public hearing. Administrator Kueffner explained the pipe <br />that is going in to serve the 150 acres owned by United Properties has been oversized to serve the entire <br />440 acres. The City has made application several years ago which was a direction by the previous <br />Council. There have been no public hearings about a possible change in the zoning of the additional 290 <br />acres. Mrs. Bucheck also stated that the Minnesota Design Team recommended low impact open space <br />commercial development along 1-94 based on the wishes of the City residents and on a site visit. <br />B. Resolution supporting the Town of Grant's petition to incorporate. <br />Grant Township has submitted its Petition by Resolution to the Minnesota Municipal Board for <br />incorporation as a City and requests Lake Elmo's support in this endeavor. <br />M/S/P Johnston/DeLapp - to adopt Resolution No. 96-13, A Resolution supporting and recommending <br />approval of the petition of Grant Township, Washington County, for Incorporation. (Motion passed 3-0). <br />C. Bob Johnson regarding letter from Code Enforcement Officer <br />Bob Johnson, 10323 47th St. N., has received a summons in the mail to go to court on August 5th for an <br />unauthorized home occupation. He was told by his neighbor, Rosalie Wahl, his business was <br />grandfathered in. Attorney Filla explained it doesn't appear the home occupation is grandfathered in <br />when he reviewed the regulations that were in place when Mr. Johnson started his business. Attorney <br />Fills will meet or talk to Mr. Johnson by phone before August 5th to get this resolved. <br />
