D. Request —Update Storm Water Plan <br />The VBWD called and asked if there were any projects the City would like included in the Budget. The <br />Council suggested they look at proposed projects for Downs Lake and the Old Village area. <br />M/S/P Dunn/DeLapp — to direct the staff to contact the VBWD about the Sunnybrook Lake Outlet Project <br />and ask for the proposed solution be sent to the City. (Motion passed 5-0). <br />The Council suggested a yearly joint meeting with the VBWD to discuss projects in general and their <br />impact on Lake Elmo. <br />8. PLANNING. LAND USE & ZONING: <br />A. Site Plan —Farmer's Union Co -Op Oil <br />The conditions differ from those recommended by the Planning Commission at its August 9th meeting. <br />The variances approved by the Planning Commission involving signage of the site have been appealed and <br />the Council will hear the appeal at the September 7" Council meeting. <br />M/S/P DeLapp/Dunn — to request the applicant comply with 85% of the exterior surfacing of structures <br />being brick, stone or equivalent as required by the Code. (Motion passed 3-2:Armstrong, Siedow:This is <br />typical construction for gas stations. Council member Armstrong also noted that Farmer's Union should <br />not look for the City to provide a water source other than their well.) <br />M/S/P Siedow/Armstrong — to approve the site plan of Farmers Union Co -Op Oil for a 4,800 square foot <br />structure at Manning Avenue and State Highway 5, modified as follows: <br />1. Modification of the site plan to provide at least 23 off street parking spaces not including parking at the <br />pump islands. The site plan shall show the location and design of 23 off street parking spaces, but only the <br />10 spaces depicted on the site plan adjacent to the store need be constructed. The remaining 13 spaces shall <br />be considered "Proof of Parking" and need only be constructed following a City determination that a need <br />for additional off street parking is observed. <br />2. Modification of the site plan to comply with building setbacks for the canopies. <br />3. Modification of the site plan in a manner that will result in at least 85% of the exterior surfacing of <br />structures being compliant with the Highway Business Zone exterior surfacing standards. <br />Due to variance appeal scheduled for September 7th, no action taken on signage. (Motion passed 5-0). <br />B. Site Plan Amendment — Creative Office Gardens (Steve Ethan) <br />At its August 91" meeting, the Planning Commission recommended denial of a site plan amendment <br />proposed by the applicant. The amendment proposed is to substitute wood shingles for the previously <br />approved and Code compliance stone exterior surfacing over a portion of the structure's exterior walls. <br />The Planning Commission vote to deny was 7-2 (Lipman, Helwig). <br />Planner Dillerud reported it appears that the GB zoning district standards require a specific finding of <br />"equivalency" for any exterior materials used other than stone, glass, or brick. He could not locate any <br />such "equivalency" finding or objection to by the Commission or Council regarding the wood shingles <br />approved for the majority of this structure and now proposed for the balance of the structure, except by <br />implication with the original approvals of the site plan. There are no amendments to the GB standards for <br />exterior resurfacing that may have postdated the original site plan approval. The standards were the same <br />when the original site plan was reviewed in 1997 as they are now. <br />Steve Ethan asked for a site plan amendment to substitute wood shingles for stone exterior surfacing on the <br />front of the Creative Office Gardens structure. <br />LAKE ELMO CITY COUNCIL MINUTES AUGUST 17, 1999 <br />
