HomeMy WebLinkAboutItem 15 Res 2013-37 Olson Lk Trl Sewer Amendment 5-7-131 Resolution No. 2013-37 CITY OF LAKE ELMO COUNTY OF WASHINGTON STATE OF MINNESOTA RESOLUTION NO. 2013-37 APPROVING AN AMENDMENT TO THE CITY OF LAKE ELMO COMPREHENSIVE PLAN WHEREAS, the City of Lake Elmo (“City”) has established a Comprehensive Plan that provides a compilation of background data, policy statements, standards, and maps, which help to guide the future physical, social, and economic development of the City; and WHEREAS, The City has received a request from the City of Oakdale to consider participating in a joint project that would extend sanitary sewer service to a limited number of properties along Olson Lake Trail that are currently on private treatment systems; and WHEREAS, based on feedback from residents along Olson Lake Trail that would benefit from an extension of sewer from the City of Oakdale, City has agreed to participate in a joint project to extend sewer to a limited number of residences in Lake Elmo, and WHEREAS, this area was not previously identified by the City as a future sewer service area and the City has therefore prepared an amendment to Chapter VI of the Lake Elmo Comprehensive Plan (Wastewater Facilities) in order to revise the Metropolitan Urban Service Area (MUSA) for the City to include homes along Olson Lake Trail that may be served by an extension of sewer service from the City of Oakdale in the future; and WHEREAS, the Lake Elmo Planning Commission held a public hearing on April 22, 2013 to consider the request to amend the Comprehensive Plan; and WHEREAS, on April 22, 2013 the Lake Elmo Planning Commission adopted a motion to recommend that the City Council approve the request to amend the Comprehensive Plan; and WHEREAS, the City Council reviewed the recommendation of the Planning Commission and the proposed amendment to the Comprehensive Plan at its May 7, 2013 meeting. NOW, THEREFORE, based upon the testimony elicited and information received, the City Council makes the following: FINDINGS 1) That the Comprehensive Plan amendment would revise Chapter VI – Wastewater Facilities of the Lake Elmo Comprehensive Plan to expand the City’s MUSA boundary and to identify 2 Resolution No. 2013-37 a portion of the residential lots along Olson Lake Trail that will be connected to municipal sanitary sewer service in the future. Said Comprehensive Plan Amendment includes a map of the properties to be served. 2) That the City has conducted a feasibility study that documents it is reasonable and cost-effective for the City to provide sanitary sewer service to the identified properties along Olson Lake Trail. NOW, THEREFORE, BE IT RESOLVED, that based on the foregoing, the Lake Elmo City Council hereby approves an amendment to Chapter VI – Wastewater Facilities of Lake Elmo Comprehensive Plan to serve a limited number of residential lots along Olson Lake Trail with public sanitary sewer service, subject to and contingent upon the following: 1) Submission of the Comprehensive Plan Amendment to the Metropolitan Council and the receipt of formal notification from the Metropolitan Council that its review has been completed and approved. ADOPTED BY THE LAKE ELMO CITY COUNCIL ON THE SEVENTH DAY OF MAY, 2013.
