FISCAL IMPACT: Estimated by County at $33,064.78. The County intends to require cost participation from the City in the amount of $33,064.78 per the County Cost participation Policy for County Improvements. SUMMARY AND ACTION REQUESTED: The City Council is respectfully requested to consider approving a Resolution Approving a Cooperative Agreement with Washington County for the State Aid Highway 15 (Manning Avenue) Phase 1 Improvements. LEGISLATIVE HISTORY/BACKGROUND INFORMATION: The City Council approved a resolution of support for the CSAH 15 (Manning Avenue) Phase 1 Improvements at the October 20, 2015 council meeting. The improvements include a signalized intersection at CSAH 10 and at the south entrance of the Oakland Jr. High School, associated intersection City Council Meeting [Regular Agenda item 14] April 5, 2016 -- page 2 -- turn lane improvements, drainage provisions, and a bituminous trail along the boulevard adjacent to Oakland Jr. High School. In accordance with the County Cost Participation Policy, the County is requesting City cost participation for these improvements in the amount of $33,064.78. This includes $12,628.38 for 55% share for right- of-way acquisition at the northwest intersection of CSAH 10 and CSAH 15; $10,023.60 for 50% share for a bituminous trail and concrete pedestrian ramps adjacent to Oakland Jr. High School and at the intersection of CSAH 10; $9,591.00 for 50% share for concrete curb and gutter along the west side of Manning Avenue; and $821.80 for mobilization, traffic control, and engineering design and construction administration costs. The cost participation estimate provided for the Cooperative Agreement is slightly increased from the estimate of $36,930 presented last October for Municipal Consent. Since Municipal Consent was provided last October, the County has finalized the design and received contractor bids for the improvements to begin construction this spring. The Cooperative Agreement sets forth the provisions that authorizes the County to implement the improvements including engineering design, construction administration, testing, right-of-way and easement acquisition, including the use of eminent domain, and retaining a contractor for project construction. The Agreement also outlines the City’s obligations for cost participation including payment terms and schedule. The costs are estimated for the purpose of the Cooperative Agreement, however the actual cost participation by the City will be determined using the City’s share of the actual project costs for each respective cost participation item. Staff has previously noted for Council that the approved design layout provides for a signalized intersection at the south school entrance. This intersection is near the required future City street access location based upon CSAH 15 access spacing guidelines. However, at the time that a development or other purpose requires a City street connection to Manning Avenue in this vicinity, it is highly probable that the entire intersection, including the traffic signals proposed by this project will need to be relocated at City cost or at the cost of a prospective developer. RECOMMENDATION: Staff is recommending that the City Council approve Resolution 2016-22 Approving a Cooperative Agreement with Washington County for the State Aid Highway 15 (Manning Avenue) Phase 1 Improvements. The recommended motion for the action is as follows: “Move to approve Resolution No. 2016-22 approving Cooperative Agreement 10144 with Washington County for the State Aid Highway 15 (Manning Avenue) Phase 1 Improvements.” ATTACHMENT(S): 1. The City shall pay 100 percent of an invoice amount within 30 days of receipt. H. CONTRACT CHANGES 1. Any modifications or additions to the final approved plans and/or specifications of the City’s portion of the project shall be made part of the construction contract through a written amendment to the construction contract, but only after concurrence by the City Engineer, and the cost for such changes shall be appropriated as set forth in Section F of this Agreement. 2.
