BACKGROUND: Earlier this year the City issued a Request for Proposals (RFP) for prosecution services. Proposals from seven firms were received and the City Council selected Johnson and Turner in March. ISSUE BEFORE COUNCIL: Should the Council issue a Request for Proposals for Prosecution Services? PROPOSAL: Council Members Fliflet and Lundgren requested this item be discussed at the work session. Concerns have been raised about continuing with Johnson and Turner in light of the fact that one of their partners is also a partner in Agincourt LLC who contested their assessment for sewer and streets as part of the downtown
project. FISCAL IMPACT: Staff time to issue the RFP and review proposals. Johnson and Turner monthly retainer for 2018 is $3,708 and is included in the 2018 budget. Legal fees for the defense of the special assessment were at $16,652.84 as of the end of September. The League has not received the final billing from the attorney but rough estimates would be in the $20,000+ range. The city will have to cover all of that cost since the deductible was raised to $200,000. OPTIONS: Discuss whether or not staff should bring the RFP to a Council meeting for approval.
