AGENDA ITEM: Amendment to MNDOT Agreement for TH 36

BACKGROUND: The deadline for the completing the study work on TH 36 is currently April 2018. MNDOT has provided an amendment and resolution language to extend that to the end of 2018 to allow the City extra time if needed.
ISSUE BEFORE COUNCIL: Should the Council approve the amendment to the MNDOT Agreement 03330?
PROPOSAL: Included in your packet is a resolution and a copy of the amendment to the agreement. The amendment
updates the City Administrator information and extends the termination until 12/31/18. FISCAL IMPACT: NA OPTIONS: 1) Approve the attached resolution 2) Do not approve a resolution and the termination date will remain in April 2018 RECOMMENDATION: If removed from the consent agenda:

STATE OF MINNESOTA RESOLUTION NO. 2017-140
A RESOLUTION AMEND MNDOT GRANT AGREEMENT #03330
WHEREAS, the City of Lake Elmo received an $80,000 grant to study roadway approach alternatives along TH 36 between Hilton Trail and Manning Ave leading up to the St. Croix River Crossing in April 2013; and
WHEREAS, said grant funds expire in April 2018; and WHEREAS, the City of Lake Elmo is requesting an extension until December 31, 2018.
NOW THERFORE, IT IS RESOLVED, that pursuant to Minnesota Statute Sec. 161.36, the
Commissioner of Transportation be appointed as Agent of the City of Lake Elmo to accept as its agent, federal aid funds which may be made available for eligible transportation related projects. BE IT FURTHER RESOLVED, that the Mayor and the City Clerk are hereby authorized and
directed for and on behalf of the City to execute and enter into an agreement with the
Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in “Minnesota Department of Transportation Agency Agreement No. 03330”, a copy of which said agreement was before the City Council and which is made part hereof by reference.
