ISSUE BEFORE COUNCIL: To consider the installation ofstreet Iights by the Cty within the Tana Ridge Developrnen on Lily Avenue North. PROPOSAL DETAILS/ANA !YSIS: Petition Gathercd. Residents ofTana Ridge held a meeling on Decemher 8, 2016, during which Uie necessity of street ]ights within the development vas discussed, Residents at this rneeting signed a petition requesting the City to instail the street Iights, Ten signatures were gathered in tiiis petition. a t ta ch ed, Past Practice. Staffconductcd research in Lo sirnilar past requests, and il was found that at least one such request was inade in July of2015. This vas a request for a street 1iht at the intcrsection ofTH36 and 1iighlands Trail, and the reason for thc request was to address a safety concern to assist in identiiying the iiitersection Iocaiion to allow vchicles sufficient brakin distances along TI-I36, Both Puhlic Works aucl the Fire Chief reviewed the intersection and supported the installation request. The cost of this instaliation was S2200. Lighting Standards. tJsually a developer pays for tlie cost ofstreetlight installation. There are 110 standards that require Iighting within a developinent; only standards that regulate lighiing. Quote Received. Staffrequested a quote frowi Xcel for the installation offour 30-40W LED cobra tixtures on 3OE direci buried flherglass poles on Lily Avenue, and Xeel provided a quote. which is attaclied. City Counci/ Workshop 2/14/17 1. Standard Service = 818.31 per mo x 12 mo = 8219.72 x 25 yrs. = 85.493.00. Xcel Energy rnaintains this system as long as the customer requests. Staffasked the SheriftTs office to provide the City with a list ofcalls to this neighborhood over the past 12 months that were vandalism related and solicited feedback about the safety ofthe neighborhood. Sgt. Jacobson replied with the foliowing coininent:" Therc were no ICR's t'or any address on Lily Ave. that involve anything close to vandalism. There was one stolen trailer case and lots of"suspicious vehicle" calls, but nothing that turned into anything. Most were vehicles that were eilher going to or coming fronl an address in the devclopment. The Lake Elino deputies do not have aily concerns about the area. lfresidents are seeing stuff and not reporting it they should start cailing the sheriff's office so they can get a hetier bandle 011 any activity in the area. Staff Feeclback. The Pub1ic Works Director lias driven through the neighhorhood to assess its need for streetliglits. It is ofStafTopinion that: Stjee lights should not be used to prevent vandalism. as they are typically instatled to ilnprove safety for motorists and pedestrians, iiot holding varidais at bay. lnstalling these streeilights would not benefit the greater good ofthe City, only the residents of Tana Ridge, as Lilv Avenue is a dead-end street. Street and Lily Avenue would be an option. Staffhas asked Xcel for a quole on this and received the following response: o An LED cobra flxwre fed overhead on the existing wood pole at this intersection could be installed at a cost ofapprox. 8400.00 upfron. o A fiberglass pole fecl underground with an LED cobra flxture would be a few tliousand dollars upfront. • The 1-lonieowner's Association could install the streetlights after applying for and being issued ftight-of-Way permits. All snow and ice not removed from public sidewalks lZhours after the snow and ice has stopped precipitating. The owner or occupant of every building or tract of land within the corporate limits of this municipality zoned for commercial, business, or industrial use, and fronting upon any street, having a sidewalk abutting upon said premises shall clear such sidewalk of snow and ice within twenty four (24)hours following the termination ofany snow storm o'the formation of ice in either case, whichever is later, and keep the same reasonably clear and free from snow and ice. The following rules and regulations shall apply to snow and ice removal from all city sidewalks: (A) Except as otherwise established by division (B) of this section, each owner and occupant of any building, in front of which or adjacent to which a sidewalk has been constructed for use bythe public, shall clear that sidewalk of snow or ice within 12 hours after said snow or ice has ceased to be deposited thereon. If the snow or ice shall not be removed within 12 hours, the owner or occupant can either be prosecuted for a misdemeanor or the city can give written notice to the owner or occupant clemandingremoval of the snow or ice within 24 hours from the date set forth in the notice, and upon failure of the owner or occupant to remove the snow or ice within said period, the city may have the work done either by its employees or by contract, and the cost of said work shall then be billed against the owner or occupant. If the owner or occupant shall fail to pay the bill within 30 days, the Council may then assess the amount due, plus interest' against the property. Once written notice has been given tothe owner or occupant, no subsequent storm or condition can effect that notice except that the time for compliance shall be continued until 12 hours after said new snow or ice have ceased to be deposited thereon. Once written notice has been given, and before compliance, any subsequent snow orice shall bedeemed tobeincluded insaid notice; (D) The Council may byresolution, and after hearing, designate that certain sidewalks within the city shall be kept clean of snow and ice by the city, thereby relieving the owner or occupant of that duty, and the city shall keep records of all expenses, including legal, and in August of each year shall bill each owner or occupant for their share or any part thereof of all expenses incurred by the city. If the owner or occupant shall fail to pay the bill as submitted by the city within 30 days, the Council may then assess the amount, plus interest, against the property; ([) Conditions: (l) Winds of less than 15 mph shall not be considered sufficient cause for not keeping sidewalks clear ofsnow and ice; (2) Written notice shall be sent to: both owners and occupants where the property is used for industrial, commercial and residential purposes; to owners where the property is used for apartments orduplexes orwhere the property isvacant; (3) Property ownership for the purposes cf this section shall bedetermined bythe city the same way property ownership isdetermined for assessment purposes; (4) For the purposes of this section all sidewalks located on or next to a public street or alley shall beconsidered for public use and shall becontrolled bythis section; (D) This section shall not be construed to affect the responsibility or liability of the property owners for damages to persons or property because of the condition of the sidewalk. The city shall not 6eheld asassuming any such liability byreason ofits removing the snow or ice under this section. If the city decides to assume the liability when it does the snow or ice removal, the cost ufinsurance covering such operations shall beconsidered asacost tobepaid bythe property owners.
