BACKGROUND:
Residents of the Tana Ridge development have requested street lights within the development on Lily
Avenue. The reason for the street light request is for possible mitigation of recent vandalism within the
neighborhood and to offer another level of safety for walkers and drivers at night.
ISSUE BEFORE COUNCIL:
To consider the installation of street lights by the City within the Tana Ridge Development on Lily
Avenue North.
PROPOSAL DETAILS/ANALYSIS:
Petition Gathered. Residents of Tana Ridge held a meeting on December 8, 2016, during which the
necessity of street lights within the development was discussed. Residents at this meeting signed a
petition requesting the City to install the street lights. Ten signatures were gathered in this petition,
attached.
Past Practice. Staff conducted research in to similar past requests, and it was found that at least one such
request was made in July of 2015. This was a request for a street light at the intersection of TH36 and
Highlands Trail, and the reason for the request was to address a safety concern to assist in identifying the
intersection location to allow vehicles sufficient braking distances along TH36. Both Public Works and
the Fire Chief reviewed the intersection and supported the installation request. The cost of this
installation was $2200.
Lighting Standards. Usually a developer pays for the cost of streetlight installation. There are no
standards that require lighting within a development; only standards that regulate lighting.
Quote Received. Staff requested a quote from Xcel for the installation of four 30-40W LED cobra
fixtures on 30’ direct buried fiberglass poles on Lily Avenue, and Xcel provided a quote, which is
attached.

1. Standard Service = $18.31 per mo x 12 mo = $219.72 x 25 yrs. = $5,493.00. Xcel Energy
maintains this system as long as the customer requests. Xcel Energy will replace the system
like for like after 25 years if needed at no additional upfront cost to the customer.
2. Pre-Pay Option = $4.38 per mo x 12 mo = $52.56 x 25 yrs. = $1,314.00 + $2,968.23 (upfront
cost for 1 light) = $4,282.23. Xcel Energy will only maintain lights for 25 years after this
time customer must pay to have new lights installed.
Research in to Vandalism. Staff asked the Sheriff’s office to provide the City with a list of calls to this
neighborhood over the past 12 months that were vandalism related and solicited feedback about the safety
of the neighborhood. Sgt. Jacobson replied with the following comment:” There were no ICR’s for any
address on Lily Ave. that involve anything close to vandalism. There was one stolen trailer case and lots
of “suspicious vehicle” calls, but nothing that turned into anything. Most were vehicles that were either
going to or coming from an address in the development. The Lake Elmo deputies do not have any
concerns about the area. If residents are seeing stuff and not reporting it they should start calling the
sheriff’s office so they can get a better handle on any activity in the area.
Staff Feedback. The Public Works Director has driven through the neighborhood to assess its need for
streetlights. It is of Staff opinion that:
• Street lights should not be used to prevent vandalism, as they are typically installed to improve
safety for motorists and pedestrians, not holding vandals at bay.
• Installing these streetlights would not benefit the greater good of the City, only the residents of
Tana Ridge, as Lily Avenue is a dead-end street.
• Alternative Options.
• Perhaps installing a streetlight at the intersection of 50th Street and Lily Avenue, which would
serve both traffic and pedestrians on both 50th Street and Lily Avenue would be an option.
Staff has asked Xcel for a quote on this and received the following response:
o An LED cobra fixture fed overhead on the existing wood pole at this intersection
could be installed at a cost of approx. $400.00 upfront.
o A fiberglass pole fed underground with an LED cobra fixture would be a few
thousand dollars upfront.
• The Homeowner’s Association could install the streetlights after applying for and being
issued Right-of-Way permits.
FISCAL IMPACT:
The costs associated with this project are outlined above. If the Council decides that the City should pay
for the installation of these streetlights, it should also decide if the City should choose the pre-pay or
standard installation cost option.
OPTIONS:
Council may:
• Deny the request that the City pay for installation of street lights on Lily Avenue within the Tana
Ridge Development.
• Approve installation of one streetlight along 50th Street and Lily Avenue North.

• Approve the request that the City pay for installation of street lights on Lily Avenue within the
Tana Ridge Development.
RECOMMENDATION:
For reasons outlined above, Staff does not recommend that the City pay for the installation of the four
requested street lights within the Tana Ridge Development on Lily Avenue North. If the Council wishes
to deny the request, it may do so with the following motion:
“Move to deny the request the City pay for installation of streetlights along Lily Avenue of the Tana
Ridge Development.”
The Council may choose to pay for the installation of one streetlight at the intersection of 50th Street
North and Lily Avenue North. If the Council wishes to pay for the installation of this one streetlight, it
may do so with the following motion:
“Move to approve the installation of one streetlight at the intersection of 50th Street North and Lily
Avenue North at a cost of either: a) $400 for an LED cobra fixture fed overhead on the existing wood
pole or b) (approximately) $2,000 for a fiberglass pole fed underground with an LED cobra fixture.”
The Council may choose to approve the request for the City to pay for the installation of four streetlights
within the Tana Ridge Development. It must also choose the pre-pay installation option or the standard
installation cost option.

Development with the pre-pay installation cost option.”

The Pre-Pay Option upfront installation cost is - $11,872.90. The monthly pre-pay option rate (A30) 30-40W (4,000 Lumens) Light Emitting Diode per luminaire is - $4.38. Under our Standard Service Option the customer pays for excess footage only. There is a higher monthly fee per luminaire for the electricity and maintenance. Angela, Would I be able to get another quote for street lights on Lily Avenue within the City? This is off of 50th Street in the City towards the northeastern portion of the City. Residents are looking for pricing for 3-4 street lights (we would probably go with the LED cobra design similar to the ones we had in Tablyn Park as they were the most cost-effective). Please let me know what more I would need to do to obtain a quote for this.

Once that meeting is over and it is clear that everyone is in favor we will proceed with your request and collect petition. Short version is that there has been a lot of vandalism in the neighborhood. Additionally the lighting offers another level of safety for walkers and drivers at night as the area is used heavily by both human and animal traffic.

We were thinking about 3 to 4 lights and mostly are open minded as to where the lights would be installed as long as it generally covers Lily ave N. Please proceed with the quote. (23) Snow on streets and sidewalks. All snow and ice not removed from public sidewalks 12 hours
after the snow and ice has stopped precipitating. Snow plowed or shoveled into a public street shall be
declared a nuisance;

within the corporate limits of this municipality zoned for commercial, business, or industrial use, and
fronting upon any street, having a sidewalk abutting upon said premises shall clear such sidewalk of

formation of ice in either case, whichever is later, and keep the same reasonably clear and free from
snow and ice.

or abutting the public sidewalk to clear the sidewalk of snow and ice.

§ 94.21 SNOW AND ICE REMOVAL.
The following rules and regulations shall apply to snow and ice removal from all city sidewalks:
(A) Except as otherwise established by division (B) of this section, each owner and occupant
of any building, in front of which or adjacent to which a sidewalk has been constructed for use
by the public, shall clear that sidewalk of snow or ice within 12 hours after said snow or ice has
ceased to be deposited thereon. If the snow or ice shall not be removed within 12 hours, the
owner or occupant can either be prosecuted for a misdemeanor or the city can give written
notice to the owner or occupant demandingremoval of the snow or ice within 24 hours from the
date set forth in the notice, and upon failure of the owner or occupant to remove the snow or
ice within said period, the city may have the work done either by its employees or by contract,
and the cost of said work shall then be billed against the owner or occupant. If the owner or
occupant shall fail to pay the bill within 30 days, the Council may then assess the amount due,
plus interest, against the property. Once written notice has been given to the owner or
occupant, no subsequent storm or condition can effect that notice except that the time for
compliance shall be continued until 12 hours after said new snow or ice have ceased to be
deposited thereon. Once written notice has been given, and before compliance, any subsequent
snow or ice shall be deemed to be included in said notice;
(B) The Council may by resolution, and after a hearing, designate that certain sidewalks within
the city shall be kept clean of snow and ice by the city, thereby relieving the owner or occupant
of that duty, and the city shall keep records of all expenses, including legal, and in August of
each year shall bill each owner or occupant for their share or any part thereof of all expenses
incurred by the city. If the owner or occupant shall fail to pay the bill as submitted by the city
within 30 days, the Council may then assess the amount, plus interest, against the property;
(C) Conditions:
(1) Winds of less than 15 mph shall not be considered sufficient cause for not keeping
sidewalks clear of snow and ice;
(2) Written notice shall be sent to: both owners and occupants where the property is used
for industrial, commercial and residential purposes; to owners where the property is used for
apartments or duplexes or where the property is vacant;
(3) Property ownership for the purposes of this section shall be determined by the city the
same way property ownership is determined for assessment purposes;
(4) For the purposes of this section all sidewalks located on or next to a public street or alley
shall be considered for public use and shall be controlled by this section;
(D) This section shall not be construed to affect the responsibility or liability of the property
owners for damages to persons or property because of the condition of the sidewalk. The city
shall not be held as assuming any such liability by reason of its removing the snow or ice under
this section. If the city decides to assume the liability when it does the snow or ice removal, the
cost of insurance covering such operations shall be considered as a cost to be paid by the
property owners.
Sidewalk/Trail Snow Removal Options
(from PW standpoint)
1) Follow existing ordinance. Residents are responsible for removing snow from sidewalks.
2) PW plows trails.
3) Downtown District
a) Contract out in entirety
b) PW removes/clears snow in front of businesses and areas without snow storage (i.e.
lawns/boulevards). Business owners would be responsible to shovel snow to curb line for
removal.
4) PW does all sidewalks and trails. Would need additional equipment for sidewalks.
5) Timing for removal. How soon would the snow need to be removed?
a) As soon as plows go out would require an increase in staffing or delay in street plowing.
b) 24hrs may need additional staffing as crews maybe cleaning, winging and salting streets.
c) 48hrs could likely be handled by staff on hand.
6) Salt. Would we salt the trails/walks?

VII. SIDEWALK SNOW REMOVAL
As there are a limited number of personnel available, sidewalk cleaning will begin as soon as
possible after significant snowfall and continue until complete unless interrupted by changing
weather conditions, equipment failure or other factors. The City will maintain sidewalks by moving
snow with a snowblower or plow. Sidewalks will be cleared of accumulated snow, but will not be
maintained to a “clean pavement” condition (i.e., one to two inches of snow will remain on
sidewalks after snowblowing operations). Sidewalks along major arterial roads such as trunk
highways and county roads, which are impacted by plowing operations of other agencies, will be
open as feasible during winter months. Sidewalks will be cleared as close as feasible to pedestrian
push-button pedestals.
Sidewalks are sorted into three groups.
PRIORITY 1
Downtown sidewalks, school walking routes and high use areas along main roads.
PRIORITY 2
Walks expanding out from the school and along major roads.
PRIORITY 3
Residential and industrial areas.
