HomeMy WebLinkAbout2017-117 - CopyCITY OF LAKE ELMO WHEREAS, the City of Lake Elmo (the "City") has established a Zoning Map by Ordinance that implenients the various land use policies in the City's Comprehensive Plan; and WHEREAS, Mare Affair Farm, LLC, 10880 Stillwater Blvd N, Lake Elmo, NIN 55042 (the "Applicant") has submitted an application to the City for a Zoning Map Amendment to rezone the property located at: 10880 Stillwater Boulevard North, PID# 14.029.21.11.0001, legally described as follows: A INTMr ORKWIN n1=0 (the -PropOV') from RT - Rural Development Transitional to A - Agricultural, a copy of which application is on file in the City Planning Department; and WHEREAS, the Comprehensive Plan describes the development of the City of Lake Elmo through 2030; WHEREAS, the Comprehensive Land Use Map describes the areas of the City (Metropolitan Urban Service Area or "MUSA") that are eligible to receive urban utilities and the future land uses of lands that will develop through 2030; and WHEREAS, the Property is located within the MUSA; and WHEREAS, the Property is zoned RT - Rural Development Transitional, which is an interim holding zone that will regulate land uses within those portions of the City planned and staged for development that will connect to regional sewer service in accordance with the Comprehensive Plan and is consistent with the Property being located within the MUSA; and WHEREAS, the A- Agricultural District is for properties that are to be served by on -site wastewater treatment facilities; and WHEREAS, the Planning Commission held a public hearing on September 11, 2017 to consider the Applicant's requests; and WHEREAS, the Planning Commission submitted its report and recominendation 509010vi SJS LA515-1 to the City Council as part of a StaffMemorandum dated October 3, 2017; and WHEREAS, the City Council considered said matter at its meetings on October 3, 2017 and October 17, 2017; NOW THEREFORE BE IT RESOLVED based upon the testimony elicited and inforniation received, the City Council makes the following findings of fact: FINDINGS 1. That the Applicant has submitted a request for a Zoning Map Amendment in accordance with the procedures as established by the Lake Elmo Planning Department and Lake Elmo Planning Commission. 2. That the request is to amend the Zoning Map by rezoning the Property from RT — Rural Development Transitional to A — Agricultural. 3. That the rezoning the Property to A - Agricultural is inappropriate because the Property is located within the MUSA and agricultural property does not utilize municipal services whereas the RT- Rural Development Transitional District is for land that will connect to regional sewer service. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Lake Elmo City Council hereby denies the request by Mare Affair Farm, LLC to amend the City of Lake Elmo Zoning Map by re-zorring the Property from RT — Rural Development Transitional to A — Agricultural.
