litCITY OF LN" ELMO <br />A <br />S LIJTION NO. 20I -024 <br />RE,50L LET ION AI'PRO VINE THE Lt V L 1'E'S AGREE11ENT FOR BOULDERPOND,,Y 4TH <br />ADDITION <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing under the laws <br />of the State of Minnesota; and <br />WHEREAS, EAS, Trident Development, LLC, 3601 18" Street Seth 113, St. Cloud, MN 56301 <br />"Applicant" has previously submitted an application to the City of Lake Elmo ("City") for a Final Plat for <br />Boulder Ponds; and <br />WHEREAS, the Lake Elmo City Council considered and approved the Preliminary plat request for <br />Boulder Ponds at a meeting held on September 16, 2014; and <br />WHEREAS, The Lake Elmo City Council adopted Resolution No. 2018-108 on September 18, 201 <br />approving the Final Plat for Boulder Ponds 41h Addition; and <br />WHEREAS, A condition of said Resolution No. 01 -108 establishes that, prier to the execution of <br />the Final Plat by City officials, the Applicant is to enter into a Developer's Agreement with the City; and <br />WHEREAS, the Applicant and City have entered into such a contract, and a copy of the Developer' <br />Agreement was submitted to the City Council for approval at its September 18, 2018 meeting. <br />WHEREAS, the contract that was approved has since been amended to reflect the current developer of <br />the site so that "Boulder Ponds Senior Living L LC" will be recognized as the developer. Developer <br />Agreements for Boulder Ponds 41h Addition identified as having a different developer shall not be considered <br />the official approved agreement. <br />NOW, THEREFORE, based on the information received, the City Council of the City of Lake Elmo <br />does hereby approve the amended Developer's Agreement for Boulder Ponds 4�b Addition and authorizes the <br />Mayor and City Clerk to execute the document. <br />Passed and duty adopted this 1 gym' day of April, 20 b rmc� o the City of L a e Eli o, Minnesota. <br />n� <br />Mike Pearson, Mayor <br />ATTEST; <br />Jimlm 4nson,iterl: <br />
