ADDITION
WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing under the laws
of the State of Minnesota; and
WHEREAS, EAS, Trident Development, LLC, 3601 18" Street Seth 113, St. Cloud, MN 56301
"Applicant" has previously submitted an application to the City of Lake Elmo ("City") for a Final Plat for
Boulder Ponds; and
WHEREAS, the Lake Elmo City Council considered and approved the Preliminary plat request for
Boulder Ponds at a meeting held on September 16, 2014; and
WHEREAS, The Lake Elmo City Council adopted Resolution No. 2018-108 on September 18, 201
approving the Final Plat for Boulder Ponds 41h Addition; and
WHEREAS, A condition of said Resolution No. 01 -108 establishes that, prier to the execution of
the Final Plat by City officials, the Applicant is to enter into a Developer's Agreement with the City; and
WHEREAS, the Applicant and City have entered into such a contract, and a copy of the Developer'
Agreement was submitted to the City Council for approval at its September 18, 2018 meeting.
WHEREAS, the contract that was approved has since been amended to reflect the current developer of
the site so that "Boulder Ponds Senior Living L LC" will be recognized as the developer. Developer
Agreements for Boulder Ponds 41h Addition identified as having a different developer shall not be considered
the official approved agreement.
NOW, THEREFORE, based on the information received, the City Council of the City of Lake Elmo
does hereby approve the amended Developer's Agreement for Boulder Ponds 4�b Addition and authorizes the
Mayor and City Clerk to execute the document.
