ITEM: Consider a stipulation agreement with the Sunfish Lake Homeowners
Associations (HOA) related to wastewater

SUMMARY AND ACTION REQUESTED: The city council is being asked to approve a
negotiated stipulation agreement between the Hamlet on Sunfish Lake and the city to address the
the handling of wastewater. Representatives of the Hamlet on Sunfish Lake and the city have
been discussing solutions to wastewater treatment issues resulting from failing waste systems in
the Hamlet for several months. The two parties recently came to an agreement on how to resolve
this issue. The staff recommends approving the agreement.
KEY TERMS:
• The HOA will construct improvements to the wastewater system at its own costs.
• The HOA will connect to sanitary sewer when it becomes available.
RECOMMENDATION
Amicably resolving the wastewater treatment issues with Sunfish Lake is to the city’s and the
Sunfish Lake HOA’s best interest. The staff recommends approving the agreement.
Possible motion for consideration
Move to approve the stipulation agreement between the Hamlet on Sunfish Lake and the city of
Lake Elmo.
