Motion
ITEM: Consider referring the Ziertman’s, 5761 Keats Avenue, concerns to the League of
Minnesota Cities for independent review, evaluation and recommendations

SUMMARY AND ACTION REQUESTED: The city council is being asked to authorize the city
administrator to request the League of Minnesota Cities Insurance Trust (LMCIT) to independently review, evaluate and make recommendations on the concerns expressed by the Ziertmans at the June
5, 2007 city council meeting. The League would not be undertaking this activity to defend the city of
Lake Elmo in a law suit because one does not exist at this time, but to independently assess the Ziertmans’s concerns and how they have been managed by the city with the understanding that the
city is interested in this independent audit. The League will also be asked to provide
recommendations on what, if any, measures the city should consider undertaking to address the concerns should the investigation find some or all of them to be valid. The League is expert in city
issues, codes, laws and practices and it is very well positioned to evaluate the concerns. The cost of
the independent assessment would be covered by the city’s insurance rates paid to the LMCIT. The
source of funds for any possible remedies would need to be determined upon the recommendation.
ADDITIONAL INFORMATION
Administrator Hoyt spoke to League General Counsel Tom Grundhoefer about the League’s services in
this regard with an emphasis that the city is looking for an assessment of how this has been managed and not looking to be defended in its past actions.
All parties concerned would be alerted to this request.
The League is being directed to be thorough and, as always, respectful of all parties and property
when doing this evaluation. This would include notifying property owners about when their property
would be viewed by the League representatives so they could be there.
