AGENDA ITEM: Recommendation for Valley Branch Watershed District Board

BACKGROUND:
Anthony Haider recently relocated within Lake Elmo however into a different watershed district. This has
created a vacancy for the remainder of his term on the Valley Branch Watershed District.
The appointment process for watershed district managers as stated in Minnesota Chapter 103D.311
provides that County Commissioners must select district managers from a list of nominees "submitted
jointly or severally" by the municipalities that are wholly or partially in the watershed district. Such a list
must be submitted to the County at least 60 days prior to the expiration of term of office of a manager. If
no list is submitted, the County Board may then appoint a manager through its open appointment process.
No person shall be appointed who is not a voting resident of the watershed district and none shall be a
public officer of the county, state or federal government, provided that a soil and water conservation
supervisor may be appointed as manager.
ISSUE BEFORE COUNCIL:
Who should the Council recommend to the Washington County Board of Commissioners for Appointment
to the Valley Branch Watershed District?
PROPOSAL:
We’ve been made aware that two Lake Elmo residents have submitted applications for appointment to the
Valley Branch Watershed District. The applications of Mr. Link Lavey and Dr. John Hamerly were
previously provided to the Council. Either gentleman meets the statutory requirements for appointment. I
have clarified with the county that Dr. Hamerly is again eligible. He was noticed as not eligible due to not
being the chosen candidate when he applied the initial time. The City can submit up to three names for
consideration and recommend one to the County Board. Recommendations are due November 15th.

2) Recommend Appointment of John Hamerly
3) Recommend Appointment of someone else in Lake Elmo and Valley Branch Watershed District
4) Make no recommendation
