ISSUE BEFORE COUNCIL: Should the City Council approve Pay Request No. 1 for the 2019 Seal Coat
project?
BACKGROUND: The 2019 Seal Coat Project was completed as a joint services contract between the City
of Lake Elmo and West Lakeland Township. Pearson Bros, Inc. was awarded a construction contract on
May 21, 2019 to complete seal coating in each municipality. The initial seal coating work has been
completed and final sweeping may occur after August 16, 2019.
PROPOSAL DETAILS/ANALYSIS: Pearson Brothers has submitted Pay Request No. 1 in the amount
of $111,120.74. The request has been reviewed and payment is recommended in the amount requested. The
work completed for Lake Elmo streets was $55,325.08. Per the Joint Services Agreement, West Lakeland
Township will be invoiced $61,644.12 for their portion of the construction costs. A 5% retainage of the
total work will be held until sweeping is complete.
FISCAL IMPACT: None. Payment is proposed in accordance with the Contract for the project. Payment
remains within the authorized scope and budget amount for Lake Elmo streets. West Lakeland Township
will be invoiced for its share of the project costs.
RECOMMENDATION: Staff is recommending that the City Council approve, as part of the Consent
Agenda, Pay Request No. 1 for the 2019 Seal Coat project. If removed from the consent agenda, the
recommended motion for the action is as follows:
“Move to approve Pay Request No. 1 to Pearson Brothers, Inc. in the amount of $111,120.74 for the
2019 Seal Coat Project; which includes $55,325.08 for work completed in the City of Lake Elmo, and
$61,644.12 for work completed in West Lakeland Township”
