AGENDA ITEM: Authorize the Use of Facsimile Signatures – Resolution 2019-057
BACKGROUND:
Pursuant to State Statute 47.41, the City Council is respectfully being asked to authorize the use of
facsimile signatures and authorize the bank to honor instruments bearing these signature by authorized
individuals.
QUESTION BEFORE THE CITY COUNCIL:
1) Should the City Council adopt the resolution as attached?
FISCAL IMPACT:
Authorizing the use of facsimile signatures helps to ensure compliance with MN State Statute.
OPTIONS:
1) Approve the attached resolution authorizing the use of facsimile signatures as listed.
2) Amend and then approve the attached resolution authorizing the use of facsimile signatures as
listed.
RECOMMENDATION:
1) Adopt Resolution No. 2019-057; A Resolution Authorizing the Use of Facsimile Signatures.

RESOLUTION 2019-057
A RESOLUTION AUTHORIZE THE USE OF FACSIMILE SIGNATURES
WHEREAS, Minnesota Statutes, Chapter 47.41, permits the use of facsimile signatures
by any public officer who is authorized to sign checks, drafts, warrants, warrant-checks, vouchers,
and check-orders on public funds; and
WHEREAS, the statute allows the City to authorize the bank to honor instruments bearing
a facsimile of authorized persons’ signatures;
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Lake Elmo,
directs that the financial institution (depositories/banks), with which the City does business, are
authorized and requested to accept, honor, cash, pay or transfer, without limit as to the amount or
without further inquiry, checks bearing the authorized signature(s) using facsimile whether
tendered in payment or deposited in the account of the City.
