#13 - Boulder Ponds Security Reductions
STAFF REPORT DATE: September 17, 2019 CONSENT AGENDA ITEM: Private Development Projects – Approve Security Reduction for Boulder Ponds 2nd Addition Landscaping Improvements SUBMITTED BY: Ben Prchal, City Planner REVIEWED BY: Ken Roberts, Planning Director ISSUE BEFORE COUNCIL: Should the City Council approve the final security reduction(s) for the Boulder Ponds 2nd Addition Landscaping Improvements? PROPOSAL DETAILS/ANALYSIS: Staff has received and processed requests to reduce the development security in accordance with the various development projects. These requests have been reviewed and the following reductions are being recommended for approval: Current Security Amount Proposed Security Reduction Amount 1. Boulder Ponds 1st Addition: $3,125 $0 2. Boulder Ponds 2nd Addition: $93,750 $93,750 3. Boulder Ponds 5th Street: $1,000 $0 Work within each of these developments has progressed in accordance with the respective development agreement and to the extent necessary to support a reduction in the security as detailed in this report. During the previous landscaping reduction for the 1st and 2nd phases and 5th St. the City held $3,125 until 5 additional trees were planted following construction of the homes within the neighborhood, and $1,000 for some minor plantings needed along the 5th Street median. The landscape architects memo (Dated July 3, 2018) is attached which explains this further and is what the Staff recommendation is based off of. The City will continue to hold the remaining $4,125 until the developer addresses the outstanding items. FISCAL IMPACT: It is the City’s goal to retain a security amount that is sufficient to cover all improvements needed to address public needs should the developer default. This is done to protect the city and taxpayers from financial harm. With this reduction, the remaining security amount held by the City remains sufficient to complete the remaining improvements, specifically related to landscaping. At this point there has not been a reduction for Phase 3. RECOMMENDATION: Staff is recommending that the City Council approve, as part of the Consent Agenda, the security reductions for the Boulder Ponds 2nd Addition Landscaping Improvements as detailed in this report and supporting documentation. If removed from the consent agenda, the recommended motion for the action is as follows: “Move to approve security reductions for the Boulder Ponds 2nd Addition Landscaping Improvements as detailed in the attached Security Reduction Worksheets.” ATTACHMENTS: 1. Security Reduction Worksheet – Boulder Ponds 1st Addition. 2. Security Reduction Worksheet – Boulder Ponds 2nd Addition. 3. Security Reduction Worksheet – Boulder Ponds 5th Street Improvements. 4. Findings: 1. All previous punch list items from the May 30, 2018 and June 21, 2018 inspections have been completed. 2. 5th street irrigation system curb stop has been flagged. The depth of the valve housing cover is at grade and shouldn’t be an issue for Public Works to access in the future. 3. Verified that the replacement trees requested following the May 30, 2018 inspection were installed on June 26, 2018. One replacement tree settled after installation and will be reset to plumb by the landscape contractor. See attached for location. 4. There are 5 trees that have not been installed yet in Phase 1 and along 5th street. Mostly so the space is being kept open for construction on empty lots or for traffic around the island in the roadway. See attached for locations. 5. There is a section where the planting is struggling on the 5th street median. There is one section where all species are present and growing but stunted. Then there is a section where liatris is present, some of the little bluestem is missing and most of the Dutch master daffodil is absent. See attached for location. The financial security to ensure compliance and performance for at least two years after installation can be released, except for the following amounts retained to address the noted findings above: 1. $3,125.00 – 125% of the 5 missing trees that still need to be installed X $500 each. 2. $1,000.00 – for additional 5th street median planting Sincerely, Lucius Jonett, PLA (MN) Wenck Associates, Inc.
