ISSUE BEFORE COUNCIL: Should the City Council accept a Petition for municipal water service from the properties at 9757 45th Street North, 9759 45th Street North, and 9765 45th Street North, and table any further action by the City until such time that adequate grant funding assistance is made available that would provide for an economically feasible improvement project? BACKGROUND AND PROPOSAL DETAILS/ANALYSIS: A petition requesting municipal water service was received on October 5, 2020 from the properties at 9757 45th Street North, 9759 45th Street North, and 9765 45th Street North. The petition was signed by all 3 of the properties that would be abutting the requested improvements as reviewed and verified by the City Clerk. The properties are located just west of the Tapestry neighborhood and south of 45th Street. Access to each of the properties is along a shared private driveway from 45th Street North, and extending approximately 1,700 to the south. The properties are located just east of the Washington County landfill and are located in the Special Well Construction Area due to PFAS contamination. The PFAS contamination exceeds HBV
levels for one of the properties. Due to the Special Well Construction Area and PFAS contamination, the City of Lake Elmo has requested
State funding to extend municipal water service to these properties. However, to date, the funding assistance has not been made available. In addition, the most recent draft of the MPCA/DNR Clean Drinking Water Supply Plan (CDWSP) to address PFAS contamination in Washington County does not recommend
municipal water to these properties at this time. However, the plan does propose a contingency fund for future municipal water extension projects as they may be deemed necessary. Preliminary total estimated project costs to provide municipal water service to the 3 properties is $400,000. This includes construction of the public watermain, engineering, private water service connections, meter fees, user charges and well abandonment. Drainage and utility easements will be necessary to implement the project as requested and it is assumed that all easements will be dedicated at no cost. Given the high cost of the project, the receipt of outside grant assistance will be needed to wholly or partially reduce the cost burden of the improvements on the homeowners. Therefore, staff does not recommend moving forward with additional engineering in the development of a feasibility report and preparation of plans and cost estimates until such time that outside grant assistance is received to provide a economically viable
improvement. RECOMMENDATION: Staff is recommending that the City Council approve a resolution declaring
adequacy of the petition for municipal water service for the properties at 9757 45th Street North, 9759 45th
Street North, and 9765 45th Street North, and deferring further action by the City until adequate grant
funding assistance can be obtained. The recommended motion for this action is as follows:
“Move to approve Resolution No. 2020-100, Declaring the Adequacy of the 45th Street Private Drive Petition for Municipal Water Service and Deferring Further Action by the City.” ATTACHMENTS: 1. A RESOLUTION DECLARING ADEQUACY OF THE 45TH STREET PRIVATE DRIVE PETITION FOR MUNICIPAL WATER SERVICE AND DEFERRING FURTHER ACTION BY THE CITY WHEREAS, a petition was received from the owners of real property residing at 9757 45th Street North, 9759 45th Street North, and 9765 45th Street North, requesting municipal water service; and WHEREAS, these properties are located in the Special Well Construction Area due to PFAS contamination and remedies are available to address private well contamination from PFAS through the Minnesota Pollution Control Agency; and WHEREAS, preliminary cost estimates for the proposed improvements have identified that the extension of municipal water service is not an economically feasible improvement without the receipt of outside grant assistance to wholly or partially reduce the cost burden of the improvements on the homeowners; and
WHEREAS, should the improvements be constructed, it is proposed to assess all or a portion of the cost of these improvements pursuant to the City’s Special Assessment Policy and Minnesota Statutes,
Chapter 429. NOW, THEREFORE, IT IS HEREBY RESOLVED, 1. The Petition requesting the improvements is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformity to Minnesota Statutes 429.035. 2. No further action is to be taken by the City until such time that adequate grant funding assistance is made available that would provide for an economically feasible improvement project.
