SUBMITTED BY: Jack Griffin, City Engineer REVIEWED BY: Kristina Handt, City Administrator Ken Roberts, Planning Director Marty Powers, Public Works Director Chad Isakson, Assistant City Engineer ISSUE BEFORE COUNCIL: Should the City Council accept the improvements and approve security reductions for the Hammes Estates 1st Addition? PROPOSAL DETAILS/ANALYSIS: Staff has received and processed a request to accept the improvements, reduce the development security, and release public sanitary sewer and watermain warranty security for the Hammes Estates 1st Addition. This request has been reviewed and the following reduction is being recommended: Current Security Amount Proposed Security Amount 1. Hammes Estates 1st Add. $1,441,912 $750,901 The Hammes Estates 1st Addition street and drainage improvements are now in the warranty period per the attached Certificate of Completion. Twenty-five percent (25%) of the original security amount will be retained until the warranty period expires on November 17, 2021 for street and drainage improvements. The sanitary sewer and watermain in the Hammes Estates 1st Addition was completed and accepted by the City on September 5, 2017 and the 2-year warranty period began. A security in the amount of 25% of the original security amount ($222,406) was retained for the warranty period. A review was completed by City staff to verify all warranty items have been fully addressed by the Developer. Subsequently, staff has received and is processing a request from the developer to release the warranty security for the public sanitary sewer and watermain in Hammes Estates 1st Addition. Release of the warranty security is recommended. This release of security is conditioned on the developer bringing their escrow accounts into compliance. FISCAL IMPACT: It is the City’s goal to retain at all times during the subdivision improvements a security amount that is adequate to ensure completion of all elements of the improvements as protection to the City tax payers against the potential of developer default. Release of the warranty security brings the public sanitary sewer and watermain portion of the project to a close. The operation and maintenance of the sanitary sewer and watermain becomes the responsibility of the City going forward. RECOMMENDATION: Staff is recommending that the City Council, as part of the Consent Agenda, accept the improvements, approve the security reduction, and release warranty security for public sanitary sewer and watermain for the Hammes Estates 1st Addition as detailed in the attached worksheet contingent upon the escrow account being brought into compliance. If removed from the consent agenda, the recommended motion for the action is as follows: “Move to accept improvements, approve the security reduction, and release warranty security for public sanitary sewer and watermain for the Hammes Estates 1st Addition as detailed in the attached Security Reduction Worksheet with the contingent upon the escrow account being brought into compliance”.
