HomeMy WebLinkAbout#18 - Summary Publication of Ordinance 08-240 STAFF REPORT DATE: November 17, 2020 REGULAR TO: City Council FROM: Ken Roberts, Planning Director AGENDA ITEM: Planned Unit Development Code Amendments – Summary Ordinance Publication REVIEWED BY: BACKGROUND: On November 4, 2020, the City Council approved several changes and updates to the PUD ordinance with a 3-0 vote (Council members Nelson and Dorschner were absent). The changes included removing the possibility of a developer getting amenity points for contained parking and for pedestrian improvements within a PUD. Other changes approved by the Council clarified processes and updated application requirements to meet current City standards and practices. As part of the ordinance amendment approval, Staff recommended Council approval of publishing a summary ordinance of the changes. To do so, however, requires four affirmative votes of the City Council. ISSUE BEFORE THE CITY COUNCIL: The City Council is being asked to adopt a Resolution authorizing summary publication for the adopted ordinance. REVIEW AND ANALYSIS: As noted above, the City Council approved several changes and updates to the PUD ordinance on November 4, 2020. Because there were only three council members in attendance, City staff is bringing back to the Council a resolution to authorizing a summary publication of the ordinance. Such a Resolution requires approval by at least 4 of the City Council members. RECOMMENDATION: City staff is recommending adoption of a Resolution authorizing summary publication for the adopted ordinance. “Move to approve Resolution 2020 - XXX, which is a summary publication of Ordinance XXX.” ATTACHMENT: Resolution 2020 - XXX (for summary publication) 2 CITY OF LAKE ELMO COUNTY OF WASHINGTON STATE OF MINNESOTA RESOLUTION NO. 2020-093 RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE 08-240 WHEREAS, on November 4, 2020, the Lake Elmo City Council has adopted Ordinance No. 08- 240, an ordinance amending the City’s PUD ordinance (Article XIX).
